88 AN ACT
99 relating to the regulation by the Railroad Commission of Texas of
1010 certain pits used for the storage and disposal of oil and gas waste.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter D, Chapter 91, Natural Resources
1313 Code, is amended by adding Section 91.119 to read as follows:
1414 Sec. 91.119. REGULATIONS REGARDING RESERVE AND MUD
1515 CIRCULATION PITS. (a) In this section:
1616 (1) "Mud circulation pit" means a pit used in
1717 conjunction with a drilling rig for the storage of drilling fluid
1818 being used in drilling operations.
1919 (2) "Reserve pit" means a pit used in conjunction with
2020 a drilling rig for collecting:
2121 (A) spent drilling fluids;
2222 (B) cuttings, sand, and silt; or
2323 (C) wash water used for cleaning drill pipe and
2424 other equipment at the well site.
2525 (b) The commission shall adopt rules regarding the use of
2626 reserve pits and mud circulation pits. The rules must establish:
2727 (1) minimum siting standards for reserve pits and mud
2828 circulation pits;
2929 (2) uniform technical, construction, sampling, and
3030 closure standards for reserve pits and mud circulation pits;
3131 (3) minimum and maximum bonding and financial security
3232 requirements for a person using a reserve pit for the permanent
3333 burial of oil and gas waste;
3434 (4) groundwater monitoring standards for reserve pits
3535 and mud circulation pits; and
3636 (5) standards for providing notice to and receiving
3737 permission from a landowner for the permanent burial of the oil and
3838 gas waste, including providing notice to the landowner of the type
3939 and volume of oil and gas waste to be buried in the reserve pit or
4040 mud circulation pit.
4141 (c) The standards established under Subsections (b)(1)-(4)
4242 must be consistent with analogous standards established by the
4343 commission for produced water recycling pits.
4444 (d) Not later than 30 days after the closure of a reserve pit
4545 or mud circulation pit used for the permanent burial of oil and gas
4646 waste, the operator must send a written notice of the burial of the
4747 oil and gas waste to the county clerk of the county in which the pit
4848 is located. The written notice must include a legal description of
4949 the location of the pit and the type and volume of oil and gas waste
5050 in the pit. After receiving notice of the oil and gas waste burial,
5151 the county clerk shall record the notice at no charge in the
5252 official public records of the county.
5353 SECTION 2. This Act takes effect September 1, 2025.
