6	8		relating to funding mechanisms to support the construction of
7	9		electric generating facilities.
8	10		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	11		SECTION 1. Section 34.0103, Utilities Code, is amended by
10	12		to read as follows:
11	13		Sec. 34.0104. LOANS FOR ERCOT POWER REGION. (a) The
12	14		commission may use money in the fund without further appropriation
13	15		to provide loans to finance upgrades to existing dispatchable
14	16		electric generating facilities providing power for the ERCOT power
15	17		region that result in a net increase of at least 100 megawatts of
16	18		capacity for each facility or the construction of dispatchable
17	19		electric generating facilities providing power for the ERCOT power
18	20		region that each have a generation capacity of at least 100
19	21		megawatts. The commission may use money in the fund without further
20	22		appropriation to provide loans to finance the construction of
21	23		electric generating facilities providing power for the ERCOT power
22	24		region that have a generation capacity of at least 10 megawatts
23	25		utilizing emerging technology sources of thermal dispatchable
24	26		electricity generation. For the purposes of this section, a
25	27		generating facility is considered to be dispatchable if the
26	28		facility's output can be controlled primarily by forces under human
27	29		control. A battery [An electric] energy storage facility is not
28	30		eligible for a loan under this section.
29	31		SECTION 2. This Act takes effect immediately if it receives
30	32		a vote of two-thirds of all the members elected to each house, as
31	33		provided by Section 39, Article III, Texas Constitution. If this
32	34		Act does not receive the vote necessary for immediate effect, this
33	35		Act takes effect September 1, 2025.
