68 relating to funding mechanisms to support the construction of
79 electric generating facilities.
810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. Section 34.0103, Utilities Code, is amended by
1012 to read as follows:
1113 Sec. 34.0104. LOANS FOR ERCOT POWER REGION. (a) The
1214 commission may use money in the fund without further appropriation
1315 to provide loans to finance upgrades to existing dispatchable
1416 electric generating facilities providing power for the ERCOT power
1517 region that result in a net increase of at least 100 megawatts of
1618 capacity for each facility or the construction of dispatchable
1719 electric generating facilities providing power for the ERCOT power
1820 region that each have a generation capacity of at least 100
1921 megawatts. The commission may use money in the fund without further
2022 appropriation to provide loans to finance the construction of
2123 electric generating facilities providing power for the ERCOT power
2224 region that have a generation capacity of at least 10 megawatts
2325 utilizing emerging technology sources of thermal dispatchable
2426 electricity generation. For the purposes of this section, a
2527 generating facility is considered to be dispatchable if the
2628 facility's output can be controlled primarily by forces under human
2729 control. A battery [An electric] energy storage facility is not
2830 eligible for a loan under this section.
2931 SECTION 2. This Act takes effect immediately if it receives
3032 a vote of two-thirds of all the members elected to each house, as
3133 provided by Section 39, Article III, Texas Constitution. If this
3234 Act does not receive the vote necessary for immediate effect, this
3335 Act takes effect September 1, 2025.
