| 9 | 9 | | relating to the provision of an abortion-inducing drug. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 171.063, Health and Safety Code, is |
|---|
| 12 | 12 | | amended by adding Subsection (b) to read as follows: |
|---|
| 13 | 13 | | (b) A physician may not provide to a pregnant woman an |
|---|
| 14 | 14 | | abortion-inducing drug unless the physician is physically present |
|---|
| 15 | 15 | | in this state and examines the woman in person at the time the |
|---|
| 16 | 16 | | physician provides the drug to the woman. |
|---|
| 17 | 17 | | SECTION 2. Section 151.056, Occupations Code, is amended by |
|---|
| 18 | 18 | | amending Subsection (b) and adding Subsection (b-1) to read as |
|---|
| 19 | 19 | | follows: |
|---|
| 20 | 20 | | (b) Except as provided by Subsection (b-1), this [This] |
|---|
| 21 | 21 | | section does not apply to the act of: |
|---|
| 22 | 22 | | (1) a medical specialist located in another |
|---|
| 23 | 23 | | jurisdiction who provides only episodic consultation services on |
|---|
| 24 | 24 | | request to a physician licensed in this state who practices in the |
|---|
| 25 | 25 | | same medical specialty; |
|---|
| 26 | 26 | | (2) a physician located in another jurisdiction who is |
|---|
| 27 | 27 | | providing consultation services to a medical school as defined by |
|---|
| 28 | 28 | | Section 61.501, Education Code; |
|---|
| 29 | 29 | | (3) a physician located in another jurisdiction who is |
|---|
| 30 | 30 | | providing consultation services to an institution subject to: |
|---|
| 31 | 31 | | (A) Subchapter C, Chapter 73, Education Code; or |
|---|
| 32 | 32 | | (B) Subchapter K, Chapter 74, Education Code; or |
|---|
| 33 | 33 | | (4) a physician located in another jurisdiction of a |
|---|
| 34 | 34 | | state having borders contiguous with the borders of this state who |
|---|
| 35 | 35 | | is the treating physician of a patient and orders home health or |
|---|
| 36 | 36 | | hospice services for a resident of this state to be delivered by a |
|---|
| 37 | 37 | | home and community support services agency licensed in this state. |
|---|
| 38 | 38 | | (b-1) This section applies to a consultation service |
|---|
| 39 | 39 | | described by Subsection (b)(1), (2), or (3) if the service is the |
|---|
| 40 | 40 | | provision of an abortion-inducing drug, as defined by Section |
|---|
| 41 | 41 | | 171.061, Health and Safety Code. |
|---|
| 42 | 42 | | SECTION 3. This Act takes effect September 1, 2025. |
