77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the provision of an abortion-inducing drug.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 171.063, Health and Safety Code, is
1212 amended by adding Subsection (b) to read as follows:
1313 (b) A physician may not provide to a pregnant woman an
1414 abortion-inducing drug unless the physician is physically present
1515 in this state and examines the woman in person at the time the
1616 physician provides the drug to the woman.
1717 SECTION 2. Section 151.056, Occupations Code, is amended by
1818 amending Subsection (b) and adding Subsection (b-1) to read as
1919 follows:
2020 (b) Except as provided by Subsection (b-1), this [This]
2121 section does not apply to the act of:
2222 (1) a medical specialist located in another
2323 jurisdiction who provides only episodic consultation services on
2424 request to a physician licensed in this state who practices in the
2525 same medical specialty;
2626 (2) a physician located in another jurisdiction who is
2727 providing consultation services to a medical school as defined by
2828 Section 61.501, Education Code;
2929 (3) a physician located in another jurisdiction who is
3030 providing consultation services to an institution subject to:
3131 (A) Subchapter C, Chapter 73, Education Code; or
3232 (B) Subchapter K, Chapter 74, Education Code; or
3333 (4) a physician located in another jurisdiction of a
3434 state having borders contiguous with the borders of this state who
3535 is the treating physician of a patient and orders home health or
3636 hospice services for a resident of this state to be delivered by a
3737 home and community support services agency licensed in this state.
3838 (b-1) This section applies to a consultation service
3939 described by Subsection (b)(1), (2), or (3) if the service is the
4040 provision of an abortion-inducing drug, as defined by Section
4141 171.061, Health and Safety Code.
4242 SECTION 3. This Act takes effect September 1, 2025.
