77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the designation of routes for the movement of oversize
1010 and overweight vehicles in certain counties.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter A, Chapter 623, Transportation Code,
1313 is amended by adding Section 623.009 read as follows:
1414 Sec. 623.009. DESIGNATED ROUTE IN COUNTY. (a) This section
1515 applies only to a county that:
1616 (1) has a population of less than 100,000; and
1717 (2) contains a port or is located within 15 miles of a
1818 port.
1919 (b) Notwithstanding Section 623.003, to the extent the
2020 department is required to determine a route under this chapter in
2121 the unincorporated area of a county, the department shall consult
2222 with the commissioners court of the county to designate to the
2323 department the route in that area. The commissioners court shall
2424 consult with the Texas Department of Transportation, port
2525 authorities, regional planning organizations, and trucking
2626 industry before recommending the designation of a route under this
2727 section.
2828 (c) In making a routing recommendation under this section,
2929 the commissioners court shall consider:
3030 (1) the proximity of the route to ports,
3131 transportation hubs, and intermodal facilities;
3232 (2) existing roadway conditions, infrastructure, and
3333 capacity to support oversize and overweight vehicles;
3434 (3) traffic safety concerns, including accident
3535 history and the safety of local communities;
3636 (4) environmental impacts, including air quality and
3737 noise pollution; and
3838 (5) potential for economic development, including the
3939 movement of goods to and from local businesses and industries.
4040 (d) The Texas Department of Transportation:
4141 (1) is responsible for installing appropriate signs
4242 for the designated route; and
4343 (2) shall allocate money from the state highway fund
4444 for the maintenance of the designated route if authorized under
4545 Subtitle B, Title 6.
4646 (e) The Department of Public Safety shall have authority to
4747 enforce requirements related to a route designated under this
4848 section.
4949 SECTION 2. Section 623.009, Transportation Code, as added
5050 by this Act, applies only to a routing determination made under
5151 Chapter 623, Transportation Code, on or after the effective date of
5252 this Act.
5353 SECTION 3. This Act takes effect September 1, 2025.
