77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the electronic return of a completed marriage license
1010 to a county clerk by a federal or state judge who conducted the
1111 marriage ceremony.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 2.206, Family Code, is amended by adding
1414 Subsection (a-1) to read as follows:
1515 (a-1) A current federal judge or state judge, as defined by
1616 Section 2.202, who conducts a marriage ceremony may return the
1717 license as required by Subsection (a) electronically by
1818 electronically scanning the completed license and electronically
1919 submitting the scanned image of the license to the county clerk who
2020 issued the license.
2121 SECTION 2. Section 2.208, Family Code, is amended by
2222 amending Subsection (a) and adding Subsection (a-1) to read as
2323 follows:
2424 (a) The county clerk shall record a returned marriage
2525 license and, except as provided by Subsection (a-1), mail the
2626 license to the address indicated on the application. On request by
2727 the applicants, the county clerk may e-mail the marriage license to
2828 an e-mail address provided to the county clerk by the applicants in
2929 addition to mailing the license.
3030 (a-1) If the county clerk received the returned marriage
3131 license by electronic submission under Section 2.206(a-1), the
3232 clerk shall mail a certified copy of the license to the address
3333 indicated on the application.
3434 SECTION 3. This Act takes effect September 1, 2025.
