12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

13 | 13 | | SECTION 1. Section 2.206, Family Code, is amended by adding |
---|
14 | 14 | | Subsection (a-1) to read as follows: |
---|
15 | 15 | | (a-1) A current federal judge or state judge, as defined by |
---|
16 | 16 | | Section 2.202, who conducts a marriage ceremony may return the |
---|
17 | 17 | | license as required by Subsection (a) electronically by |
---|
18 | 18 | | electronically scanning the completed license and electronically |
---|
19 | 19 | | submitting the scanned image of the license to the county clerk who |
---|
20 | 20 | | issued the license. |

21 | 21 | | SECTION 2. Section 2.208, Family Code, is amended by |
---|
22 | 22 | | amending Subsection (a) and adding Subsection (a-1) to read as |
---|
23 | 23 | | follows: |
---|
24 | 24 | | (a) The county clerk shall record a returned marriage |
---|
25 | 25 | | license and, except as provided by Subsection (a-1), mail the |
---|
26 | 26 | | license to the address indicated on the application. On request by |
---|
27 | 27 | | the applicants, the county clerk may e-mail the marriage license to |
---|
28 | 28 | | an e-mail address provided to the county clerk by the applicants in |
---|
29 | 29 | | addition to mailing the license. |
---|
30 | 30 | | (a-1) If the county clerk received the returned marriage |
---|
31 | 31 | | license by electronic submission under Section 2.206(a-1), the |
---|
32 | 32 | | clerk shall mail a certified copy of the license to the address |
---|
33 | 33 | | indicated on the application. |
---|
34 | 34 | | SECTION 3. This Act takes effect September 1, 2025. |
