57 AN ACT
68 relating to liability of public schools and professional school
79 employees for certain injuries to students.
810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. Title 5, Civil Practice and Remedies Code, is
1012 amended by adding Chapter 118 to read as follows:
1113 CHAPTER 118. LIABILITY OF PUBLIC SCHOOLS AND PROFESSIONAL
1214 EMPLOYEES OF PUBLIC SCHOOLS FOR CERTAIN INJURIES TO STUDENTS
1315 Sec. 118.001. DEFINITIONS. In this chapter:
1416 (1) "Open-enrollment charter school" has the meaning
1517 assigned by Section 5.001, Education Code.
1618 (2) "Professional school employee" includes:
1719 (A) a superintendent or administrator serving as
1820 educational leader and chief executive officer of the school,
1921 principal or equivalent chief operating officer, teacher,
2022 including a substitute teacher, supervisor, social worker, school
2123 counselor, nurse, and teacher's aide employed by a public school;
2224 (B) a teacher employed by a company that
2325 contracts with a public school to provide the teacher's services to
2426 the school;
2527 (C) a student in an education preparation program
2628 participating in a field experience or internship;
2729 (D) a school bus driver certified in accordance
2830 with standards and qualifications adopted by the Department of
2931 Public Safety of the State of Texas;
3032 (E) a member of the board of trustees of an
3133 independent school district or a member of the governing body of an
3234 open-enrollment charter school; and
3335 (F) any other person employed by a public school
3436 whose employment requires certification and the exercise of
3537 discretion.
3638 (3) "Public school" means an independent school
3739 district or an open-enrollment charter school.
3840 (4) "Sexual misconduct" means sexual abuse or conduct
3941 described by Section 20A.02, 21.02, 21.07, 21.08, 21.11, 21.12,
4042 21.15, 21.16, 21.165, 21.17, 21.18, 21.19, 22.011, 22.012, 22.021,
4143 or 43.25, Penal Code.
4244 Sec. 118.002. LIABILITY. (a) A public school is liable for
4345 an act or omission that is committed by a professional school
4446 employee against a student enrolled in the school and that is:
4547 (1) sexual misconduct;
4648 (2) failure to report suspected child abuse or neglect
4749 under Section 261.101, Family Code; or
4850 (3) any other negligent, reckless, knowing, or
4951 intentional act or omission resulting in injury to or the death of
5052 the student, including bodily injury, serious bodily injury, or
5153 serious mental deficiency, impairment, or injury, other than the
5254 use of physical force against a student to the extent justified
5355 under Section 9.62, Penal Code.
5456 (b) In an action against a public school under this chapter,
5557 the professional school employee who committed the act or omission
5658 on which the claim is based must be named as a defendant. The public
5759 school and the professional school employee are jointly and
5860 severally liable for an award in an action under this chapter.
5961 Sec. 118.003. DAMAGES. (a) A claimant who prevails in an
6062 action under this chapter shall be awarded:
6163 (1) actual damages;
6264 (2) court costs; and
6365 (3) reasonable and necessary attorney's fees.
6466 (b) In addition to an award under Subsection (a), a claimant
6567 who prevails in an action under this chapter may recover exemplary
6668 damages.
6769 Sec. 118.004. REMEDIES NOT EXCLUSIVE. The remedies
6870 authorized by this chapter are in addition to any other legal
6971 remedies.
7072 Sec. 118.005. WAIVER OF GOVERNMENTAL IMMUNITY; OFFICIAL
7173 IMMUNITY ABOLISHED. (a) A public school's governmental immunity
7274 to suit and from liability is waived to the extent of liability
7375 created by this chapter.
7476 (b) A professional school employee may not assert official
7577 immunity under Subchapter B, Chapter 22, Education Code, the common
7678 law, or any other law in an action brought under this chapter.
7779 SECTION 2. Chapter 118, Civil Practice and Remedies Code,
7880 as added by this Act, applies only to a cause of action that accrues
7981 on or after the effective date of this Act.
8082 SECTION 3. This Act takes effect September 1, 2025.
