88 AN ACT
99 relating to electric service quality and reliability.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 36.402, Utilities Code, is amended by
1212 adding Subsection (b-1) to read as follows:
1313 (b-1) Notwithstanding Subsection (b), the commission may
1414 not authorize an electric utility to receive a return on equity for
1515 repaired or replaced damaged infrastructure that the commission
1616 determines the utility should have reasonably anticipated could
1717 have been damaged by the weather-related event or natural disaster.
1818 SECTION 2. Section 38.005(b), Utilities Code, is amended to
1919 read as follows:
2020 (b) The commission may take appropriate enforcement action
2121 under this section, including action against a utility, if any of
2222 the utility's feeders with 10 or more customers has had a SAIDI or
2323 SAIFI average that is more than 200 [300] percent greater than the
2424 system average of all feeders during any two-year period[,
2525 beginning in the year 2000]. In determining the appropriate
2626 enforcement action, the commission shall consider:
2727 (1) the feeder's operating and maintenance history;
2828 (2) the cause of each interruption in the feeder's
2929 service;
3030 (3) the duration of each interruption in the feeder's
3131 service;
3232 (4) any action taken by a utility to address the
3333 feeder's performance;
3434 (5) [(4)] the estimated cost and benefit of
3535 remediating a feeder's performance; and
3636 (6) [(5)] any other relevant factor as determined by
3737 the commission.
3838 SECTION 3. Subchapter A, Chapter 38, Utilities Code, is
3939 amended by adding Section 38.006 to read as follows:
4040 Sec. 38.006. STRUCTURAL INTEGRITY STANDARDS FOR
4141 TRANSMISSION AND DISTRIBUTION POLES. (a) This section applies
4242 only to an electric utility, municipally owned utility, or electric
4343 cooperative that operates transmission or distribution assets.
4444 (b) The commission by rule shall adopt standards for the
4545 structural integrity of transmission and distribution poles.
4646 (c) The standards adopted under this section must:
4747 (1) require an electric utility, municipally owned
4848 utility, or electric cooperative to inspect transmission and
4949 distribution poles and take appropriate remedial action as
5050 necessary on a timeline established by the commission;
5151 (2) account for geographic differences between
5252 regions of the state;
5353 (3) consider national guidelines such as the National
5454 Electrical Safety Code and guidelines developed by the Rural
5555 Utilities Service of the United States Department of Agriculture;
5656 and
5757 (4) establish a classification system to assess the
5858 serviceability of transmission and distribution poles.
5959 (d) Each electric utility, municipally owned utility, and
6060 electric cooperative shall submit to the commission an annual
6161 report on:
6262 (1) the implementation of the utility's or
6363 cooperative's transmission and distribution pole maintenance
6464 schedule;
6565 (2) the results of the utility's or cooperative's
6666 inspection of transmission and distribution poles, including any
6767 remediation or replacement action taken; and
6868 (3) any other information the commission requires.
6969 SECTION 4. The heading to Subchapter E, Chapter 38,
7070 Utilities Code, is amended to read as follows:
7171 SUBCHAPTER E. INFRASTRUCTURE IMPROVEMENT AND MAINTENANCE [REPORT]
7272 SECTION 5. Section 38.101(a), Utilities Code, is amended to
7373 read as follows:
7474 (a) Not later than May 1 of each year, each electric utility
7575 shall submit to the commission a report describing the utility's
7676 activities related to:
7777 (1) identifying areas that are susceptible to damage
7878 during severe weather and hardening transmission and distribution
7979 facilities in those areas; and
8080 (2) vegetation management[; and
8181 [(3) inspecting distribution poles].
8282 SECTION 6. (a) The changes in law made by this Act to
8383 Section 38.005, Utilities Code, apply only to an enforcement action
8484 initiated by the Public Utility Commission of Texas on or after the
8585 effective date of this Act. An enforcement action initiated before
8686 the effective date of this Act is governed by the law in effect
8787 immediately before the effective date of this Act, and the former
8888 law is continued in effect for that purpose.
8989 (b) In adopting rules under Section 38.006, Utilities Code,
9090 as added by this Act, the Public Utility Commission of Texas shall
9191 allow an electric utility, electric cooperative, or municipally
9292 owned utility to complete any required inspection, remediation, or
9393 replacement of transmission and distribution poles installed
9494 before the effective date of the rules according to a reasonable
9595 timeline approved by the commission that allows the utility or
9696 cooperative to prioritize high-risk transmission and distribution
9797 poles.
9898 SECTION 7. This Act takes effect September 1, 2025.
