| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Sections 7.142(a) and (b), Water Code, are |
|---|
| 13 | 13 | | amended to read as follows: |
|---|
| 14 | 14 | | (a) A person commits an offense if the person violates: |
|---|
| 15 | 15 | | (1) Section 11.081; |
|---|
| 16 | 16 | | (2) Section 11.083; |
|---|
| 17 | 17 | | (3) Section 11.084; |
|---|
| 18 | 18 | | (4) Section 11.087; |
|---|
| 19 | 19 | | (5) Section 11.088; |
|---|
| 20 | 20 | | (6) Section 11.089; |
|---|
| 21 | 21 | | (7) Section 11.090; |
|---|
| 22 | 22 | | (8) Section 11.091; |
|---|
| 23 | 23 | | (9) Section 11.092; |
|---|
| 24 | 24 | | (10) Section 11.093; |
|---|
| 25 | 25 | | (11) Section 11.094; |
|---|
| 26 | 26 | | (12) Section 11.096; or |
|---|

| 29 | 29 | | (b) An offense under Subsection (a)(9), (a)(10), or (a)(13) |

| 31 | 31 | | [Section 7.187(1)(A) or Section 7.187(2)(B)] or both. |

| 32 | 32 | | SECTION 2. Subchapter F, Chapter 11, Water Code, is amended |
|---|
| 33 | 33 | | by adding Section 11.2011 to read as follows: |
|---|
| 34 | 34 | | Sec. 11.2011. APPLICABILITY. This subchapter, other than |
|---|
| 35 | 35 | | Sections 11.202(c) and 11.206, applies only to an artesian well |
|---|
| 36 | 36 | | drilled outside the boundaries of a groundwater conservation |
|---|
| 37 | 37 | | district, subsidence district, or other conservation and |
|---|
| 38 | 38 | | reclamation district with the authority to regulate the drilling, |
|---|
| 39 | 39 | | spacing, or production of water wells. |
|---|
| 40 | 40 | | SECTION 3. The following provisions of the Water Code are |
|---|
| 41 | 41 | | repealed: |
|---|
| 42 | 42 | | (1) Sections 11.202(d) and (e); |
|---|
| 43 | 43 | | (2) Section 11.203; |
|---|
| 44 | 44 | | (3) Section 11.204; and |
|---|
| 45 | 45 | | (4) Section 11.207. |
|---|
| 46 | 46 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 47 | 47 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 48 | 48 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 49 | 49 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 50 | 50 | | Act takes effect September 1, 2025. |
