88 AN ACT
99 relating to regulation of certain retail distribution centers;
1010 providing a civil penalty.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subtitle A, Title 9, Health and Safety Code, is
1313 amended by adding Chapter 761 to read as follows:
1414 CHAPTER 761. REGULATION OF CERTAIN RETAIL DISTRIBUTION CENTERS
1515 Sec. 761.001. DEFINITION. In this chapter, "retail
1616 distribution center" means a facility that is primarily used for
1717 the temporary storage of consumer goods, as defined by Section
1818 9.102, Business & Commerce Code, for delivery to:
1919 (1) a retail store; or
2020 (2) a customer.
2121 Sec. 761.002. APPLICABILITY. This chapter applies only to
2222 a retail distribution center:
2323 (1) that is located outside the corporate limits of a
2424 municipality; and
2525 (2) the operation of which results in the following:
2626 (A) 800 or more total vehicle trips to and from
2727 the center per day;
2828 (B) 400 or more vehicle trips to the center per
2929 day; or
3030 (C) 400 or more vehicle trips from the center per
3131 day.
3232 Sec. 761.003. PROHIBITED PROXIMITY TO SCHOOL OR HOSPITAL.
3333 A retail distribution center to which this chapter applies may not
3434 be located within two miles of:
3535 (1) a public or private school, including an
3636 open-enrollment charter school; or
3737 (2) a hospital licensed under Chapter 241, Health and
3838 Safety Code.
3939 Sec. 761.004. ENFORCEMENT; CIVIL PENALTY. (a) A person who
4040 operates a retail distribution center that violates Section 761.003
4141 is liable for a civil penalty of not more than $1,000. Each day a
4242 violation continues may be considered a separate violation for
4343 purposes of a civil penalty under this section.
4444 (b) The attorney general or the appropriate district or
4545 county attorney may bring an action on behalf of this state to
4646 collect a civil penalty under this section.
4747 (c) The attorney general or the appropriate district or
4848 county attorney, as applicable, shall deposit a civil penalty in
4949 the state treasury to the credit of the general revenue fund.
5050 SECTION 2. This Act takes effect September 1, 2025.
