| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter B, Chapter 361, Health and Safety |
|---|
| 13 | 13 | | Code, is amended by adding Section 361.0315 to read as follows: |
|---|
| 14 | 14 | | Sec. 361.0315. SCRAP TIRE REMEDIATION GRANT PROGRAM. (a) |
|---|
| 15 | 15 | | In this section, "scrap tire" has the meaning assigned by Section |
|---|
| 16 | 16 | | 361.112. |
|---|
| 17 | 17 | | (b) The commission may develop a scrap tire remediation |
|---|
| 18 | 18 | | grant program to award grants from the scrap tire remediation grant |
|---|
| 19 | 19 | | account established by this section to counties for the purpose of |
|---|
| 20 | 20 | | reducing the number of scrap tires disposed of in inland or coastal |
|---|
| 21 | 21 | | water and onto public rights-of-way and other public land. |
|---|
| 22 | 22 | | (c) The commission may award a grant under the scrap tire |
|---|
| 23 | 23 | | remediation grant program to a county to be used for: |
|---|
| 24 | 24 | | (1) identifying and prosecuting violators of Section |
|---|
| 25 | 25 | | 365.012, as that section relates to the illegal disposal of scrap |
|---|
| 26 | 26 | | tires; |
|---|
| 27 | 27 | | (2) providing information to the public to discourage |
|---|
| 28 | 28 | | the illegal disposal of scrap tires; and |
|---|
| 29 | 29 | | (3) removing and properly disposing of illegally |
|---|
| 30 | 30 | | disposed of scrap tires. |
|---|
| 31 | 31 | | (d) The scrap tire remediation grant account is a dedicated |
|---|
| 32 | 32 | | account in the general revenue fund and consists of: |
|---|
| 33 | 33 | | (1) appropriations of money to the account by the |
|---|
| 34 | 34 | | legislature; |
|---|
| 35 | 35 | | (2) gifts, grants, including federal grants, and other |
|---|
| 36 | 36 | | donations received for the account; and |
|---|
| 37 | 37 | | (3) interest earned on the investment of money in the |
|---|
| 38 | 38 | | account. |
|---|
| 39 | 39 | | (e) Money in the scrap tire remediation grant account may be |
|---|
| 40 | 40 | | used by the commission only to: |
|---|
| 41 | 41 | | (1) award grants under this section; and |
|---|
| 42 | 42 | | (2) administer the scrap tire remediation grant |
|---|
| 43 | 43 | | program under this section. |
|---|
| 44 | 44 | | (f) If the commission develops a scrap tire remediation |
|---|
| 45 | 45 | | grant program under this section, the commission shall adopt rules |
|---|
| 46 | 46 | | for the administration of that program. |
|---|
| 47 | 47 | | SECTION 2. This Act takes effect September 1, 2025. |
