77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to transfer of the ownership rights of the Woodlawn Water
1010 Supply Corporation to the Angelina and Neches River Authority.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. DEFINITIONS. In this Act:
1313 (1) "Authority" means the Angelina and Neches River
1414 Authority.
1515 (2) "Corporation" means the Woodlawn Water Supply
1616 Corporation.
1717 SECTION 2. TRANSFER OF WATER SUPPLY CORPORATION; ASSETS;
1818 DISSOLUTION. (a) The authority may enter into a contract with the
1919 corporation to transfer the assets, debts, and contractual rights
2020 and obligations of the corporation to the authority.
2121 (b) On the date a contract is executed as provided by
2222 Subsection (a) of this section:
2323 (1) all real property, easements, appurtenances,
2424 conveyance systems, transmission and treatment systems, designated
2525 rights-of-way, and other property interests of the corporation are
2626 transferred to the authority;
2727 (2) Certificate of Convenience and Necessity
2828 No. 10354 is considered to be held by the authority; and
2929 (3) the board of directors of the corporation shall
3030 notify:
3131 (A) the Texas Commission on Environmental
3232 Quality of the transfer of the corporation to the authority; and
3333 (B) the Public Utility Commission of Texas of the
3434 transfer of Certificate of Convenience and Necessity No. 10354 to
3535 the authority.
3636 (c) On receipt of notice under Subsection (b)(3)(B) of this
3737 section, the Public Utility Commission of Texas shall note in its
3838 records that Certificate of Convenience and Necessity No. 10354 is
3939 held by the authority and shall reissue the certificate in the name
4040 of the authority without further application, notice, or hearing. A
4141 person, party, or entity does not have any right of protest,
4242 objection, or administrative review of the transfer prescribed by
4343 this section.
4444 (d) Not later than 30 days after the date of the transfer
4545 under Subsection (b) of this section, the board of directors of the
4646 corporation shall commence dissolution proceedings of the
4747 corporation.
4848 SECTION 3. EFFECTIVE DATE. This Act takes effect
4949 immediately if it receives a vote of two-thirds of all the members
5050 elected to each house, as provided by Section 39, Article III, Texas
5151 Constitution. If this Act does not receive the vote necessary for
5252 immediate effect, this Act takes effect September 1, 2025.
