77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the investigation and reporting of certain motor
1010 vehicle collisions.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 550.041(a), Transportation Code, is
1313 amended to read as follows:
1414 (a) A peace officer who is notified of a motor vehicle
1515 collision resulting in injury to or death of a person or [property]
1616 damage to a motor vehicle to the [an apparent] extent that the
1717 vehicle cannot be normally and safely driven [of at least $1,000]
1818 may investigate the collision and file justifiable charges relating
1919 to the collision without regard to whether the collision occurred
2020 on property to which this chapter applies.
2121 SECTION 2. Section 550.062(a), Transportation Code, is
2222 amended to read as follows:
2323 (a) A law enforcement officer who in the regular course of
2424 duty investigates a motor vehicle collision shall make a written
2525 report of the collision if the collision resulted in injury to or
2626 the death of a person or damage to a motor vehicle to the [property
2727 of any one person to the apparent] extent that the vehicle cannot be
2828 normally and safely driven [of $1,000 or more].
2929 SECTION 3. The change in law made by this Act applies only
3030 to a motor vehicle accident occurring on or after the effective date
3131 of this Act. A motor vehicle accident occurring before the
3232 effective date of this Act is covered by the law in effect on the
3333 date the accident occurred, and the former law is continued in
3434 effect for that purpose.
3535 SECTION 4. This Act takes effect September 1, 2025.
