77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the discipline of public school students who engage in
1010 certain conduct.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 37.001, Education Code, is amended by
1313 adding Subsection (b-2) to read as follows:
1414 (b-2) The conditions described by Subsections (a)(2) and
1515 (3) must provide that a student may not be expelled or removed to a
1616 disciplinary alternative education program for a minor violation of
1717 the student code of conduct, including insubordination, disruption
1818 to the classroom, the use of offensive or profane language, or a
1919 violation related to attendance, dress, or grooming.
2020 SECTION 2. Section 37.002(c), Education Code, is amended to
2121 read as follows:
2222 (c) If a teacher removes a student from class under
2323 Subsection (b), the principal may place the student into another
2424 appropriate classroom or [,] into in-school suspension [, or into a
2525 disciplinary alternative education program as provided by Section
2626 37.008]. The principal may not return the student to that teacher's
2727 class without the teacher's consent unless the committee
2828 established under Section 37.003 determines that such placement is
2929 the best or only alternative available. The terms of the removal
3030 may prohibit the student from attending or participating in
3131 school-sponsored or school-related activity.
3232 SECTION 3. This Act applies beginning with the 2025-2026
3333 school year.
3434 SECTION 4. This Act takes effect immediately if it receives
3535 a vote of two-thirds of all the members elected to each house, as
3636 provided by Section 39, Article III, Texas Constitution. If this
3737 Act does not receive the vote necessary for immediate effect, this
3838 Act takes effect September 1, 2025.
