| 9 | 9 | | relating to the discipline of public school students who engage in |
|---|
| 10 | 10 | | certain conduct. |
|---|
| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 37.001, Education Code, is amended by |
|---|
| 13 | 13 | | adding Subsection (b-2) to read as follows: |
|---|
| 14 | 14 | | (b-2) The conditions described by Subsections (a)(2) and |
|---|
| 15 | 15 | | (3) must provide that a student may not be expelled or removed to a |
|---|
| 16 | 16 | | disciplinary alternative education program for a minor violation of |
|---|
| 17 | 17 | | the student code of conduct, including insubordination, disruption |
|---|
| 18 | 18 | | to the classroom, the use of offensive or profane language, or a |
|---|
| 19 | 19 | | violation related to attendance, dress, or grooming. |
|---|
| 20 | 20 | | SECTION 2. Section 37.002(c), Education Code, is amended to |
|---|
| 21 | 21 | | read as follows: |
|---|
| 22 | 22 | | (c) If a teacher removes a student from class under |
|---|
| 23 | 23 | | Subsection (b), the principal may place the student into another |
|---|
| 24 | 24 | | appropriate classroom or [,] into in-school suspension [, or into a |
|---|
| 25 | 25 | | disciplinary alternative education program as provided by Section |
|---|
| 26 | 26 | | 37.008]. The principal may not return the student to that teacher's |
|---|
| 27 | 27 | | class without the teacher's consent unless the committee |
|---|
| 28 | 28 | | established under Section 37.003 determines that such placement is |
|---|
| 29 | 29 | | the best or only alternative available. The terms of the removal |
|---|
| 30 | 30 | | may prohibit the student from attending or participating in |
|---|
| 31 | 31 | | school-sponsored or school-related activity. |
|---|
| 32 | 32 | | SECTION 3. This Act applies beginning with the 2025-2026 |
|---|
| 33 | 33 | | school year. |
|---|
| 34 | 34 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 35 | 35 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 36 | 36 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 37 | 37 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 38 | 38 | | Act takes effect September 1, 2025. |
