57 AN ACT
68 relating to the authority of certain municipalities to receive
79 certain tax revenue derived from a hotel and convention center
810 project and to pledge certain tax revenue for the payment of
911 obligations related to the project.
1012 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1113 SECTION 1. Section 351.152, Tax Code, is amended to read as
1214 follows:
1315 Sec. 351.152. APPLICABILITY. This subchapter applies only
1416 to:
1517 (1) a municipality described by Section
1618 351.001(7)(B);
1719 (2) a municipality described by Section
1820 351.001(7)(D);
1921 (3) a municipality described by Section
2022 351.001(7)(E);
2123 (4) a municipality described by Section
2224 351.102(e)(3);
2325 (5) a municipality that contains more than 70 percent
2426 of the population of a county with a population of 1.5 million or
2527 more;
2628 (6) a municipality with a population of 175,000 or
2729 more but less than 200,000 that is partially located in at least one
2830 county with a population of 125,000 or more;
2931 (7) a municipality with a population of 250,000 or
3032 more but less than one million that is located in one county with a
3133 population of 2.5 million or more;
3234 (8) a municipality with a population of 180,000 or
3335 more that:
3436 (A) is located in two counties, each with a
3537 population of 100,000 or more; and
3638 (B) contains an American Quarter Horse Hall of
3739 Fame and Museum;
3840 (9) a municipality with a population of 96,000 or more
3941 that is located in a county that borders Lake Palestine;
4042 (10) a municipality with a population of 96,000 or
4143 more that is located in a county that contains the headwaters of the
4244 San Gabriel River;
4345 (11) a municipality with a population of at least
4446 95,000 that is located in a county that is bisected by United States
4547 Highway 385 and has a population of not more than 170,000;
4648 (12) a municipality with a population of 110,000 or
4749 more but less than 135,000 at least part of which is located in a
4850 county with a population of less than 135,000;
4951 (13) a municipality with a population of 28,000 or
5052 more but less than 31,000 that is located in two counties, each of
5153 which has a population of 900,000 or more and a southern border with
5254 a county with a population of 2.5 million or more;
5355 (14) a municipality with a population of 200,000 or
5456 more but less than 300,000 that contains a component institution of
5557 the Texas Tech University System;
5658 (15) a municipality with a population of 95,000 or
5759 more that:
5860 (A) is located in more than one county; and
5961 (B) borders Lake Lewisville;
6062 (16) a municipality with a population of 45,000 or
6163 more that:
6264 (A) contains a portion of Cedar Hill State Park;
6365 (B) is located in two counties, one of which has a
6466 population of 2.5 million or more and one of which has a population
6567 of 190,000 or more; and
6668 (C) has adopted a capital improvement plan for
6769 the construction or expansion of a convention center facility;
6870 (17) a municipality with a population of less than
6971 10,000 that:
7072 (A) is almost wholly located in a county with a
7173 population of 900,000 or more that is adjacent to a county with a
7274 population of 2.5 million or more;
7375 (B) is partially located in a county with a
7476 population of 2.1 million or more that is adjacent to a county with
7577 a population of 2.5 million or more;
7678 (C) has a visitor center and museum located in a
7779 19th-century rock building in the municipality's downtown; and
7880 (D) has a waterpark open to the public;
7981 (18) a municipality with a population of 60,000 or
8082 more that:
8183 (A) borders Lake Ray Hubbard; and
8284 (B) is located in two counties, one of which has a
8385 population of less than 110,000;
8486 (19) a municipality with a population of 110,000 or
8587 more that:
8688 (A) borders Clear Lake; and
8789 (B) is primarily located in a county with a
8890 population of less than 355,000;
8991 (20) a municipality with a population of less than
9092 2,000 that:
9193 (A) is located adjacent to a bay connected to the
9294 Gulf of Mexico;
9395 (B) is located in a county with a population of
9496 290,000 or more that is adjacent to a county with a population of
9597 four million or more; and
9698 (C) has a boardwalk on the bay;
9799 (21) a municipality with a population of 75,000 or
98100 more that:
99101 (A) is located wholly in one county with a
100102 population of 800,000 or more that is adjacent to a county with a
101103 population of four million or more; and
102104 (B) has adopted a capital improvement plan for
103105 the construction or expansion of a convention center facility;
104106 (22) a municipality with a population of less than
105107 70,000 that is located in three counties, at least one of which has
106108 a population of four million or more;
107109 (23) an eligible coastal municipality with a
108110 population of 2,900 or more but less than 5,000;
109111 (24) a municipality with a population of 90,000 or
110112 more but less than 150,000 that:
111113 (A) is located in three counties; and
112114 (B) contains a branch campus of a component
113115 institution of the University of Houston System;
114116 (25) a municipality that is:
115117 (A) primarily located in a county with a
116118 population of four million or more; and
117119 (B) connected by a bridge to a municipality
118120 described by Subdivision (20);
119121 (26) a municipality with a population of 25,000 or
120122 more but less than 30,000 that:
121123 (A) contains a portion of Mustang Bayou; and
122124 (B) is wholly located in a county with a
123125 population of less than 500,000;
124126 (27) a municipality with a population of 70,000 or
125127 more but less than 90,000 that is located in two counties, one of
126128 which has a population of four million or more and the other of
127129 which has a population of less than 50,000;
128130 (28) a municipality with a population of 10,000 or
129131 more that:
130132 (A) is wholly located in a county with a
131133 population of four million or more; and
132134 (B) has a city hall located less than three miles
133135 from a space center operated by an agency of the federal government;
134136 (29) a municipality that is the county seat of a
135137 county:
136138 (A) through which the Pedernales River flows; and
137139 (B) in which the birthplace of a president of the
138140 United States is located;
139141 (30) a municipality that contains a portion of U.S.
140142 Highway 79 and State Highway 130;
141143 (31) a municipality with a population of 70,000 or
142144 more but less than 115,000 that is located in two counties, one of
143145 which has a population of 1.1 million or more but less than 1.9
144146 million;
145147 (32) a municipality with a population of less than
146148 25,000 that contains a museum of Western American art;
147149 (33) a municipality with a population of 50,000 or
148150 more that is the county seat of a county that contains a portion of
149151 the Sam Houston National Forest;
150152 (34) a municipality with a population of less than
151153 25,000 that:
152154 (A) contains a cultural heritage museum; and
153155 (B) is located in a county that borders the
154156 United Mexican States and the Gulf of Mexico;
155157 (35) a municipality that is the county seat of a county
156158 that:
157159 (A) has a population of 115,000 or more;
158160 (B) is adjacent to a county with a population of
159161 2.1 million or more; and
160162 (C) hosts an annual peach festival;
161163 (36) a municipality that is the county seat of a county
162164 that:
163165 (A) has a population of 800,000 or more; and
164166 (B) is adjacent to a county with a population of
165167 four million or more;
166168 (37) a municipality with a population of less than
167169 10,000 that:
168170 (A) contains a component university of The Texas
169171 A&M University System; and
170172 (B) is located in a county adjacent to a county
171173 that borders Oklahoma;
172174 (38) a municipality with a population of less than
173175 17,000 that:
174176 (A) is located in two counties, each of which has
175177 a population of 900,000 or more but less than two million; and
176178 (B) hosts an annual Cajun Festival;
177179 (39) a municipality with a population of 13,000 or
178180 more that:
179181 (A) is located on an international border; and
180182 (B) is located in a county:
181183 (i) with a population of less than 400,000;
182184 and
183185 (ii) in which at least one World Birding
184186 Center site is located;
185187 (40) a municipality with a population of 3,200 or more
186188 that:
187189 (A) is located on an international border; and
188190 (B) is located not more than five miles from a
189191 state historic site that serves as a visitor center for a state park
190192 that contains 300,000 or more acres of land;
191193 (41) a municipality with a population of 36,000 or
192194 more that is adjacent to at least two municipalities described by
193195 Subdivision (15);
194196 (42) a municipality with a population of 28,000 or
195197 more that is located in a county with a population of 240,000 or
196198 more that contains a portion of the Blanco River and in which is
197199 located a historic railroad depot and heritage center;
198200 (43) a municipality located in a county that has a
199201 population of not more than 300,000 and in which a component
200202 university of the University of Houston System is located;
201203 (44) a municipality with a population of less than
202204 500,000 that is:
203205 (A) located in two counties; and
204206 (B) adjacent to a municipality described by
205207 Subdivision (31);
206208 (45) a municipality that:
207209 (A) has a population of more than 67,000; and
208210 (B) is located in two counties with 90 percent of
209211 the municipality's territory located in a county with a population
210212 of at least 800,000, and the remaining territory located in a county
211213 with a population of at least four million;
212214 (46) a municipality that:
213215 (A) has a population of 100,000 or more; and
214216 (B) is wholly located in, but is not the county
215217 seat of, a county with a population of one million or more:
216218 (i) in which all or part of a municipality
217219 with a population of one million or more is located; and
218220 (ii) that is adjacent to a county with a
219221 population of 2.5 million or more;
220222 (47) a municipality that is the county seat of a county
221223 bordering the Gulf of Mexico and the United Mexican States;
222224 (48) a municipality that is bisected by the Guadalupe
223225 River and is the county seat of a county with a population of
224226 170,000 or more;
225227 (49) a municipality with a population of 70,000 or
226228 more but less than 150,000 that borders Joe Pool Lake;
227229 (50) a municipality with a population of 115,000 or
228230 more that borders the Neches River;
229231 (51) a municipality described by Section 351.101(k);
230232 (52) a municipality that is the county seat of a
231233 county:
232234 (A) through which the Brazos River flows; and
233235 (B) in which a national monument is located;
234236 (53) a municipality with a population of 45,000 or
235237 more that:
236238 (A) is not the county seat of a county;
237239 (B) is located in a single county; and
238240 (C) contains a portion of Lake Lewisville;
239241 (54) a municipality that is the county seat of a county
240242 with a population of more than 900,000 that is adjacent to two
241243 counties, each of which has a population of more than 1.8 million;
242244 (55) a municipality that hosts an annual wine festival
243245 and is located in three counties, each of which has a population of
244246 more than 900,000;
245247 (56) a municipality that has a population of at least
246248 150,000 but less than 1,300,000 and is partially located in a county
247249 that contains a portion of Cedar Creek Reservoir;
248250 (57) a municipality that is located in a county that
249251 contains a portion of Cedar Creek Reservoir and in which a private
250252 college is located;
251253 (58) a municipality that is the county seat of a
252254 county:
253255 (A) with a population of one million or more;
254256 (B) in which all or part of a municipality with a
255257 population of one million or more is located; and
256258 (C) that is located adjacent to a county with a
257259 population of 2.5 million or more;
258260 (59) a municipality that is the county seat of a county
259261 that contains a portion of Cedar Creek Reservoir and borders a
260262 county with a population of more than 240,000;
261263 (60) a municipality with a population of more than
262264 80,000 but less than 150,000 that is located in a county with a
263265 population of more than 369,000 but less than 864,000 that contains
264266 part of an active duty United States Army installation;
265267 (61) a municipality with a population of 750,000 or
266268 more that is located in a county with a population of 1.5 million or
267269 less;
268270 (62) a municipality with a population of less than
269271 7,000 that contains a country music hall of fame;
270272 (63) a municipality with a population of 35,000 or
271273 more that contains a railroad museum and is located in a county
272274 that:
273275 (A) has a population of 800,000 or more; and
274276 (B) is adjacent to a county with a population of
275277 four million or more; [and]
276278 (64) a municipality:
277279 (A) that is the county seat of a county:
278280 (i) with a population of 60,000 or less; and
279281 (ii) that borders the Rio Grande;
280282 (B) in which is located a United States military
281283 fort listed in the National Register of Historic Places; and
282284 (65) a municipality:
283285 (A) with a population of 16,000 or more;
284286 (B) that is located entirely within a county with
285287 a population of 2.6 million or more; and
286288 (C) that is labeled as a "town" in the most recent
287289 United States Census.
288290 SECTION 2. Section 351.157(b), Tax Code, is amended to read
289291 as follows:
290292 (b) This section applies only to:
291293 (1) a municipality described by Section 351.152(3);
292294 (1-a) a municipality described by Section 351.152(5);
293295 (2) a municipality described by Section 351.152(6);
294296 (3) a municipality described by Section 351.152(7);
295297 (4) a municipality described by Section 351.152(10);
296298 (4-a) a municipality described by Section
297299 351.152(14);
298300 (5) a municipality described by Section 351.152(16);
299301 (6) a municipality described by Section 351.152(22);
300302 (7) a municipality described by Section 351.152(25);
301303 (8) a municipality described by Section 351.152(34);
302304 (9) a municipality described by Section 351.152(35);
303305 (10) a municipality described by Section 351.152(36);

318320 SECTION 3. This Act takes effect immediately if it receives
319321 a vote of two-thirds of all members elected to each house, as
320322 provided by Section 39, Article III, Texas Constitution. If this
321323 Act does not receive the vote necessary for immediate effect, this
322324 Act takes effect September 1, 2025.
