| 9 | 9 | | relating to the closure of beaches for space flight activities; |

| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 61.132, Natural Resources Code, is |
|---|
| 13 | 13 | | amended by amending Subsection (c) and adding Subsection (g) to |
|---|
| 14 | 14 | | read as follows: |
|---|
| 15 | 15 | | (c) To protect the public health, safety, and welfare, the |
|---|
| 16 | 16 | | commissioners court by order: |
|---|
| 17 | 17 | | (1) shall compel the evacuation of any unauthorized |
|---|
| 18 | 18 | | person from a hazard area, as calculated by the Federal Aviation |
|---|
| 19 | 19 | | Administration under 14 C.F.R. Section 450.133(c), on a launch |
|---|
| 20 | 20 | | date; and |
|---|
| 21 | 21 | | (2) may temporarily close a beach in reasonable |
|---|
| 22 | 22 | | proximity to the launch site or access points to the beach in the |
|---|
| 23 | 23 | | county on a primary or backup launch date, subject to Subsection |
|---|
| 24 | 24 | | (d). |
|---|
| 25 | 25 | | (g) A person commits an offense if the person violates an |
|---|
| 26 | 26 | | order adopted under Subsection (c)(1). An offense under this |
|---|
| 27 | 27 | | subsection is a Class B misdemeanor, except that the offense is a |
|---|
| 28 | 28 | | Class A misdemeanor if the actor has previously been convicted of an |
|---|
| 29 | 29 | | offense under this subsection. |
|---|
| 30 | 30 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 31 | 31 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 32 | 32 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 33 | 33 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 34 | 34 | | Act takes effect September 1, 2025. |
