77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the closure of beaches for space flight activities;
1010 creating a criminal offense.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 61.132, Natural Resources Code, is
1313 amended by amending Subsection (c) and adding Subsection (g) to
1414 read as follows:
1515 (c) To protect the public health, safety, and welfare, the
1616 commissioners court by order:
1717 (1) shall compel the evacuation of any unauthorized
1818 person from a hazard area, as calculated by the Federal Aviation
1919 Administration under 14 C.F.R. Section 450.133(c), on a launch
2020 date; and
2121 (2) may temporarily close a beach in reasonable
2222 proximity to the launch site or access points to the beach in the
2323 county on a primary or backup launch date, subject to Subsection
2424 (d).
2525 (g) A person commits an offense if the person violates an
2626 order adopted under Subsection (c)(1). An offense under this
2727 subsection is a Class B misdemeanor, except that the offense is a
2828 Class A misdemeanor if the actor has previously been convicted of an
2929 offense under this subsection.
3030 SECTION 2. This Act takes effect immediately if it receives
3131 a vote of two-thirds of all the members elected to each house, as
3232 provided by Section 39, Article III, Texas Constitution. If this
3333 Act does not receive the vote necessary for immediate effect, this
3434 Act takes effect September 1, 2025.
