46 A BILL TO BE ENTITLED
57 AN ACT
68 relating to streamlining the deadlines for the Health and Human
79 Services Commission to submit certain required reports to the
810 Legislature.
911 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1012 SECTION 1. Section 532.0453, Government Code, is amended to
1113 read as follows:
1214 Sec. 532.0453. CONTINUED IMPLEMENTATION OF CERTAIN
1315 INTERVENTIONS AND BEST PRACTICES BY PROVIDERS; [BIANNUAL] REPORT
1416 EVERY EVEN-NUMBERED YEAR. (a) The commission shall encourage
1517 Medicaid providers to continue implementing effective
1618 interventions and best practices associated with improvements in
1719 the health outcomes of Medicaid recipients that were developed and
1820 achieved under the Delivery System Reform Incentive Payment (DSRIP)
1921 program previously operated under the Texas Health Care
2022 Transformation and Quality Improvement Program waiver issued under
2123 Section 1115 of the federal Social Security Act (42 U.S.C. Section
2224 1315), through:
2325 (1) existing provider incentive programs and the
2426 creation of new provider incentive programs;
2527 (2) the terms included in contracts with Medicaid
2628 managed care organizations;
2729 (3) implementation of alternative payment models; or
2830 (4) adoption of other cost-effective measures.
2931 (b) The commission shall [biannually] prepare and submit a
3032 report in every even-numbered year to the legislature that contains
3133 a summary of the commission's efforts under this section and
3234 Section 531.085(b).
3335 SECTION 2. Section 542.0054, Government Code, is amended to
3436 read as follows:
3537 Sec. 542.0054. [ANNUAL] REPORT EVERY EVEN-NUMERED YEAR ON
3638 IMPLEMENTATION. (a) Not later than September 30 of each
3739 even-numbered year, the commission, in consultation and
3840 collaboration with the advisory committee, shall prepare and submit
3941 a report to the legislature that must include:
4042 (1) an assessment of the implementation of the system
4143 required by this chapter, including appropriate information
4244 regarding the provision of acute care services and long-term
4345 services and supports to individuals with an intellectual or
4446 developmental disability under Medicaid as described by this
4547 chapter;
4648 (2) recommendations regarding implementation of and
4749 improvements to the system redesign, including recommendations
4850 regarding appropriate statutory changes to facilitate the
4951 implementation; and
5052 (3) an assessment of the effect of the system on the
5153 following:
5254 (A) access to long-term services and supports;
5355 (B) the quality of acute care services and
5456 long-term services and supports;
5557 (C) meaningful outcomes for Medicaid recipients
5658 using person-centered planning, individualized budgeting, and
5759 self-determination, including a person's inclusion in the
5860 community;
5961 (D) the integration of service coordination of
6062 acute care services and long-term services and supports;
6163 (E) the efficiency and use of funding;
6264 (F) the placement of individuals in housing that
6365 is the least restrictive setting appropriate to an individual's
6466 needs;
6567 (G) employment assistance and customized,
6668 integrated, competitive employment options; and
6769 (H) the number and types of fair hearing and
6870 appeals processes in accordance with applicable federal law.
6971 (b) This section expires on the second anniversary of the
7072 date the commission completes implementation of the transition
7173 required under Sections 542.0201, 542.0202, and 542.0203 [Section
7274 534.202].
7375 SECTION 3. The heading of Section 543A.008, Government
7476 Code, is amended to read as follows: [ANNUAL] REPORT EVERY
7577 EVEN-NUMBERED YEAR.
7678 SECTION 4. Section 543A.008(a), Government Code, is amended
7779 to read as follows:
7880 Sec. 543A.008. [ANNUAL] REPORT EVERY EVEN-NUMBERED
7981 YEAR. (a) The commission shall submit to the legislature and make
8082 available to the public in every even-numbered year [an annual]
8183 report regarding:
8284 (1) the quality-based outcome and process measures
8385 developed under Sections 543A.0002 and 543A.0003 [Section
8486 536.003], including measures based on each potentially preventable
8587 event; and
8688 (2) the progress of the implementation of
8789 quality-based payment systems under Section 543A.0004 and other
8890 payment initiatives implemented under this chapter.
8991 SECTION 5. If before implementing any provision of this Act
9092 a state agency determines that a waiver or authorization from a
9193 federal agency is necessary for implementation of that provision,
9294 the agency affected by the provision shall request the waiver or
9395 authorization and may delay implementing that provision until the
9496 waiver or authorization is granted.
9597 SECTION 6. The Health and Human Services Commission is
9698 required to implement a provision of this Act only if the
9799 legislature appropriates money specifically for that purpose. If
98100 the legislature does not appropriate money specifically for that
99101 purpose, the commission may, but is not required to, implement a
100102 provision of this Act using other appropriations available for that
101103 purpose.
102104 SECTION 7. This act takes effect immediately if it receives
103105 a vote of two-thirds of all the members elected to each house, as
104106 provided by Section 39, Article III, Texas Constitution. If this
105107 Act does not receive the vote necessary for immediate effect, this
106108 Act takes effect September 1, 2025.
