| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter B, Chapter 32, Human Resources Code, |
|---|
| 13 | 13 | | is amended by adding Section 32.031401 to read as follows: |

| 14 | 14 | | Sec. 32.031401. REIMBURSEMENT FOR REPAIR OF COMPLEX |
|---|
| 15 | 15 | | REHABILITATION TECHNOLOGY EQUIPMENT. (a) In this section, |
|---|
| 16 | 16 | | "complex rehabilitation technology equipment" has the meaning |
|---|
| 17 | 17 | | assigned by Section 532.0455, Government Code. |
|---|
| 18 | 18 | | (b) The executive commissioner by rule shall establish a |
|---|
| 19 | 19 | | reimbursement methodology for the repair of complex rehabilitation |
|---|
| 20 | 20 | | technology equipment prescribed to a recipient under the medical |
|---|
| 21 | 21 | | assistance program. |
|---|
| 22 | 22 | | (c) The commission shall provide medical assistance |
|---|
| 23 | 23 | | reimbursement for the repair of complex rehabilitation technology |
|---|
| 24 | 24 | | equipment without requiring a medical assistance recipient or |
|---|
| 25 | 25 | | health care provider to obtain prior authorization or |
|---|
| 26 | 26 | | precertification for the repair. |
|---|
| 27 | 27 | | SECTION 2. If before implementing any provision of this Act |
|---|
| 28 | 28 | | a state agency determines that a waiver or authorization from a |
|---|
| 29 | 29 | | federal agency is necessary for implementation of that provision, |
|---|
| 30 | 30 | | the agency affected by the provision shall request the waiver or |
|---|
| 31 | 31 | | authorization and may delay implementing that provision until the |
|---|
| 32 | 32 | | waiver or authorization is granted. |
|---|
| 33 | 33 | | SECTION 3. This Act takes effect September 1, 2025. |
