88 AN ACT
99 relating to prior authorization or precertification for the repair
1010 of complex rehabilitation technology equipment under Medicaid.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter B, Chapter 32, Human Resources Code,
1313 is amended by adding Section 32.031401 to read as follows:
1414 Sec. 32.031401. REIMBURSEMENT FOR REPAIR OF COMPLEX
1515 REHABILITATION TECHNOLOGY EQUIPMENT. (a) In this section,
1616 "complex rehabilitation technology equipment" has the meaning
1717 assigned by Section 532.0455, Government Code.
1818 (b) The executive commissioner by rule shall establish a
1919 reimbursement methodology for the repair of complex rehabilitation
2020 technology equipment prescribed to a recipient under the medical
2121 assistance program.
2222 (c) The commission shall provide medical assistance
2323 reimbursement for the repair of complex rehabilitation technology
2424 equipment without requiring a medical assistance recipient or
2525 health care provider to obtain prior authorization or
2626 precertification for the repair.
2727 SECTION 2. If before implementing any provision of this Act
2828 a state agency determines that a waiver or authorization from a
2929 federal agency is necessary for implementation of that provision,
3030 the agency affected by the provision shall request the waiver or
3131 authorization and may delay implementing that provision until the
3232 waiver or authorization is granted.
3333 SECTION 3. This Act takes effect September 1, 2025.
