77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to third-party review of development documents and
1010 inspection of improvements required to be approved by a political
1111 subdivision.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 247.002, Local Government Code, as added
1414 by Chapter 654 (H.B. 14), Acts of the 88th Legislature, Regular
1515 Session, 2023, is amended to read as follows:
1616 Sec. 247.002. THIRD-PARTY REVIEW OR INSPECTION REQUIRED.
1717 (a) If a regulatory authority does not approve, conditionally
1818 approve, or disapprove a development document, including a
1919 development permit, by the 15th day after the date prescribed by a
2020 provision of this code for the approval, conditional approval, or
2121 disapproval of the document, any required review of the document
2222 may be performed by a person:
2323 (1) other than:
2424 (A) the applicant; or
2525 (B) a person whose work is the subject of the
2626 application; and
2727 (2) who is:
2828 (A) employed by the regulatory authority to
2929 review development documents;
3030 (B) employed by another political subdivision to
3131 review development documents, if the regulatory authority has
3232 approved the person to review development documents; or
3333 (C) an engineer licensed under Chapter 1001,
3434 Occupations Code.
3535 (b) If a regulatory authority does not conduct a required
3636 development inspection by the 15th day after the date prescribed by
3737 a provision of this code for conducting the inspection, the
3838 inspection may be conducted by a person:
3939 (1) other than:
4040 (A) the owner of the land or improvement to the
4141 land that is the subject of the inspection; or
4242 (B) a person whose work is the subject of the
4343 inspection; and
4444 (2) who is:
4545 (A) certified [to inspect buildings] by the
4646 International Code Council;
4747 (B) employed by the regulatory authority as a
4848 building inspector;
4949 (C) employed by another political subdivision as
5050 a building inspector, if the regulatory authority has approved the
5151 person to perform inspections; or
5252 (D) an engineer licensed under Chapter 1001,
5353 Occupations Code.
5454 (c) A political subdivision is not liable for a review or
5555 inspection performed by a third party under this chapter.
5656 SECTION 2. Section 247.002(a), Local Government Code, as
5757 amended by this Act, and Section 247.002(c), Local Government Code,
5858 as added by this Act, are intended to clarify rather than change
5959 existing law.
6060 SECTION 3. This Act takes effect immediately if it receives
6161 a vote of two-thirds of all the members elected to each house, as
6262 provided by Section 39, Article III, Texas Constitution. If this
6363 Act does not receive the vote necessary for immediate effect, this
6464 Act takes effect September 1, 2025.
