77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the licensing and regulation of barber instructors and
1010 cosmetology instructors by the Texas Department of Licensing and
1111 Regulation and to the composition of the Barbering and Cosmetology
1212 Advisory Board.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 1603.051, Occupations Code, is amended
1515 to read as follows:
1616 Sec. 1603.051. ADVISORY BOARD; MEMBERSHIP. The Barbering
1717 and Cosmetology Advisory Board consists of nine members appointed
1818 by the presiding officer of the commission, with the commission's
1919 approval, as follows:
2020 (1) four members who each hold an individual
2121 practitioner license under Subchapter E-1, including:
2222 (A) at least one holder of a Class A barber
2323 license; [and]
2424 (B) at least one holder of a cosmetology operator
2525 license;
2626 (C) at least one holder of a barber instructor
2727 license; and
2828 (D) at least one holder of a cosmetology
2929 instructor license;
3030 (2) two members who each hold an establishment
3131 license;
3232 (3) two members who each hold a school license; and
3333 (4) one member who represents the public.
3434 SECTION 2. Section 1603.2103(a), Occupations Code, is
3535 amended to read as follows:
3636 (a) A person holding:
3737 (1) a Class A barber license may perform any barbering
3838 service;
3939 (2) a cosmetology operator license may perform any
4040 cosmetology service;
4141 (3) a manicurist license may perform any service
4242 described by Section 1603.0011(a)(7) or (8);
4343 (4) an esthetician license may perform any service
4444 described by Section 1603.0011(a)(3), (4), (5), or (6) or (c);
4545 (5) a manicurist/esthetician license may perform any
4646 service described by Section 1603.0011(a)(3), (4), (5), (6), (7),
4747 or (8) or (c);
4848 (6) a hair weaving specialist license may perform any
4949 service described by Section 1603.0011(a)(9);
5050 (7) a hair weaving specialist/esthetician license may
5151 perform any service described by Section 1603.0011(a)(3), (4), (5),
5252 (6), or (9) or (c); [and]
5353 (8) an eyelash extension specialist license may
5454 perform any service described by Section 1603.0011(c);
5555 (9) a barber instructor license may:
5656 (A) perform any barbering service; and
5757 (B) instruct a person in the performance of any
5858 barbering service; and
5959 (10) a cosmetology instructor license may:
6060 (A) perform any cosmetology service; and
6161 (B) instruct a person in the performance of any
6262 cosmetology service.
6363 SECTION 3. Subchapter E-1, Chapter 1603, Occupations Code,
6464 is amended by adding Section 1603.21035 to read as follows:
6565 Sec. 1603.21035. ELIGIBILITY FOR BARBER INSTRUCTOR OR
6666 COSMETOLOGY INSTRUCTOR LICENSE. (a) To be eligible for a barber
6767 instructor or cosmetology instructor license, an applicant must:
6868 (1) be at least 18 years of age;
6969 (2) have a high school diploma or a high school
7070 equivalency certificate;
7171 (3) hold a current Class A barber license or
7272 cosmetology operator license, as applicable;
7373 (4) have completed a course consisting of 500 hours of
7474 instruction in barber or cosmetology courses and methods of
7575 teaching in a barber or cosmetology school or commission-approved
7676 training program; and
7777 (5) pass a written and practical examination
7878 prescribed by the commission.
7979 (b) The commission shall adopt rules for the licensing of
8080 specialty instructors to teach specialty courses in any service
8181 described by Section 1603.0011(a)(3), (4), (5), (6), (7), (8), or
8282 (9) or (c).
8383 SECTION 4. Not later than December 31, 2025, the Texas
8484 Commission of Licensing and Regulation shall adopt rules to
8585 implement Section 1603.21035, Occupations Code, as added by this
8686 Act.
8787 SECTION 5. The change in law made by this Act to Section
8888 1603.051, Occupations Code, does not affect the entitlement of a
8989 member serving on the advisory committee established under that
9090 section immediately before the effective date of this Act to
9191 continue to serve for the remainder of the member's term. As the
9292 terms of members expire after the effective date of this Act, the
9393 presiding officer of the Texas Commission of Licensing and
9494 Regulation, with the commission's approval, shall appoint or
9595 reappoint members who have the qualifications required by that
9696 section.
9797 SECTION 6. This Act takes effect September 1, 2025.
