77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the authority of certain municipalities to use certain
1010 tax revenue for hotel and convention center projects.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 351.152, Tax Code, is amended to read as
1313 follows:
1414 Sec. 351.152. APPLICABILITY. This subchapter applies only
1515 to:
1616 (1) a municipality described by Section
1717 351.001(7)(B);
1818 (2) a municipality described by Section
1919 351.001(7)(D);
2020 (3) a municipality described by Section
2121 351.001(7)(E);
2222 (4) a municipality described by Section
2323 351.102(e)(3);
2424 (5) a municipality that contains more than 70 percent
2525 of the population of a county with a population of 1.5 million or
2626 more;
2727 (6) a municipality with a population of 175,000 or
2828 more but less than 200,000 that is partially located in at least one
2929 county with a population of 125,000 or more;
3030 (7) a municipality with a population of 250,000 or
3131 more but less than one million that is located in one county with a
3232 population of 2.5 million or more;
3333 (8) a municipality with a population of 180,000 or
3434 more that:
3535 (A) is located in two counties, each with a
3636 population of 100,000 or more; and
3737 (B) contains an American Quarter Horse Hall of
3838 Fame and Museum;
3939 (9) a municipality with a population of 96,000 or more
4040 that is located in a county that borders Lake Palestine;
4141 (10) a municipality with a population of 96,000 or
4242 more that is located in a county that contains the headwaters of the
4343 San Gabriel River;
4444 (11) a municipality with a population of at least
4545 95,000 that is located in a county that is bisected by United States
4646 Highway 385 and has a population of not more than 170,000;
4747 (12) a municipality with a population of 110,000 or
4848 more but less than 135,000 at least part of which is located in a
4949 county with a population of less than 135,000;
5050 (13) a municipality with a population of 28,000 or
5151 more but less than 31,000 that is located in two counties, each of
5252 which has a population of 900,000 or more and a southern border with
5353 a county with a population of 2.5 million or more;
5454 (14) a municipality with a population of 200,000 or
5555 more but less than 300,000 that contains a component institution of
5656 the Texas Tech University System;
5757 (15) a municipality with a population of 95,000 or
5858 more that:
5959 (A) is located in more than one county; and
6060 (B) borders Lake Lewisville;
6161 (16) a municipality with a population of 45,000 or
6262 more that:
6363 (A) contains a portion of Cedar Hill State Park;
6464 (B) is located in two counties, one of which has a
6565 population of 2.5 million or more and one of which has a population
6666 of 190,000 or more; and
6767 (C) has adopted a capital improvement plan for
6868 the construction or expansion of a convention center facility;
6969 (17) a municipality with a population of less than
7070 10,000 that:
7171 (A) is almost wholly located in a county with a
7272 population of 900,000 or more that is adjacent to a county with a
7373 population of 2.5 million or more;
7474 (B) is partially located in a county with a
7575 population of 2.1 million or more that is adjacent to a county with
7676 a population of 2.5 million or more;
7777 (C) has a visitor center and museum located in a
7878 19th-century rock building in the municipality's downtown; and
7979 (D) has a waterpark open to the public;
8080 (18) a municipality with a population of 60,000 or
8181 more that:
8282 (A) borders Lake Ray Hubbard; and
8383 (B) is located in two counties, one of which has a
8484 population of less than 110,000;
8585 (19) a municipality with a population of 110,000 or
8686 more that:
8787 (A) borders Clear Lake; and
8888 (B) is primarily located in a county with a
8989 population of less than 355,000;
9090 (20) a municipality with a population of less than
9191 2,000 that:
9292 (A) is located adjacent to a bay connected to the
9393 Gulf of Mexico;
9494 (B) is located in a county with a population of
9595 290,000 or more that is adjacent to a county with a population of
9696 four million or more; and
9797 (C) has a boardwalk on the bay;
9898 (21) a municipality with a population of 75,000 or
9999 more that:
100100 (A) is located wholly in one county with a
101101 population of 800,000 or more that is adjacent to a county with a
102102 population of four million or more; and
103103 (B) has adopted a capital improvement plan for
104104 the construction or expansion of a convention center facility;
105105 (22) a municipality with a population of less than
106106 70,000 that is located in three counties, at least one of which has
107107 a population of four million or more;
108108 (23) an eligible coastal municipality with a
109109 population of 2,900 or more but less than 5,000;
110110 (24) a municipality with a population of 90,000 or
111111 more but less than 150,000 that:
112112 (A) is located in three counties; and
113113 (B) contains a branch campus of a component
114114 institution of the University of Houston System;
115115 (25) a municipality that is:
116116 (A) primarily located in a county with a
117117 population of four million or more; and
118118 (B) connected by a bridge to a municipality
119119 described by Subdivision (20);
120120 (26) a municipality with a population of 25,000 or
121121 more but less than 30,000 that:
122122 (A) contains a portion of Mustang Bayou; and
123123 (B) is wholly located in a county with a
124124 population of less than 500,000;
125125 (27) a municipality with a population of 70,000 or
126126 more but less than 90,000 that is located in two counties, one of
127127 which has a population of four million or more and the other of
128128 which has a population of less than 50,000;
129129 (28) a municipality with a population of 10,000 or
130130 more that:
131131 (A) is wholly located in a county with a
132132 population of four million or more; and
133133 (B) has a city hall located less than three miles
134134 from a space center operated by an agency of the federal government;
135135 (29) a municipality that is the county seat of a
136136 county:
137137 (A) through which the Pedernales River flows; and
138138 (B) in which the birthplace of a president of the
139139 United States is located;
140140 (30) a municipality that contains a portion of U.S.
141141 Highway 79 and State Highway 130;
142142 (31) a municipality with a population of 70,000 or
143143 more but less than 115,000 that is located in two counties, one of
144144 which has a population of 1.1 million or more but less than 1.9
145145 million;
146146 (32) a municipality with a population of less than
147147 25,000 that contains a museum of Western American art;
148148 (33) a municipality with a population of 50,000 or
149149 more that is the county seat of a county that contains a portion of
150150 the Sam Houston National Forest;
151151 (34) a municipality with a population of less than
152152 25,000 that:
153153 (A) contains a cultural heritage museum; and
154154 (B) is located in a county that borders the
155155 United Mexican States and the Gulf of Mexico;
156156 (35) a municipality that is the county seat of a county
157157 that:
158158 (A) has a population of 115,000 or more;
159159 (B) is adjacent to a county with a population of
160160 2.1 million or more; and
161161 (C) hosts an annual peach festival;
162162 (36) a municipality that is the county seat of a county
163163 that:
164164 (A) has a population of 800,000 or more; and
165165 (B) is adjacent to a county with a population of
166166 four million or more;
167167 (37) a municipality with a population of less than
168168 10,000 that:
169169 (A) contains a component university of The Texas
170170 A&M University System; and
171171 (B) is located in a county adjacent to a county
172172 that borders Oklahoma;
173173 (38) a municipality with a population of less than
174174 17,000 that:
175175 (A) is located in two counties, each of which has
176176 a population of 900,000 or more but less than two million; and
177177 (B) hosts an annual Cajun Festival;
178178 (39) a municipality with a population of 13,000 or
179179 more that:
180180 (A) is located on an international border; and
181181 (B) is located in a county:
182182 (i) with a population of less than 400,000;
183183 and
184184 (ii) in which at least one World Birding
185185 Center site is located;
186186 (40) a municipality with a population of 3,200 or more
187187 that:
188188 (A) is located on an international border; and
189189 (B) is located not more than five miles from a
190190 state historic site that serves as a visitor center for a state park
191191 that contains 300,000 or more acres of land;
192192 (41) a municipality with a population of 36,000 or
193193 more that is adjacent to at least two municipalities described by
194194 Subdivision (15);
195195 (42) a municipality with a population of 28,000 or
196196 more that is located in a county with a population of 240,000 or
197197 more that contains a portion of the Blanco River and in which is
198198 located a historic railroad depot and heritage center;
199199 (43) a municipality located in a county that has a
200200 population of not more than 300,000 and in which a component
201201 university of the University of Houston System is located;
202202 (44) a municipality with a population of less than
203203 500,000 that is:
204204 (A) located in two counties; and
205205 (B) adjacent to a municipality described by
206206 Subdivision (31);
207207 (45) a municipality that:
208208 (A) has a population of more than 67,000; and
209209 (B) is located in two counties with 90 percent of
210210 the municipality's territory located in a county with a population
211211 of at least 800,000, and the remaining territory located in a county
212212 with a population of at least four million;
213213 (46) a municipality that:
214214 (A) has a population of 100,000 or more; and
215215 (B) is wholly located in, but is not the county
216216 seat of, a county with a population of one million or more:
217217 (i) in which all or part of a municipality
218218 with a population of one million or more is located; and
219219 (ii) that is adjacent to a county with a
220220 population of 2.5 million or more;
221221 (47) a municipality that is the county seat of a county
222222 bordering the Gulf of Mexico and the United Mexican States;
223223 (48) a municipality that is bisected by the Guadalupe
224224 River and is the county seat of a county with a population of
225225 170,000 or more;
226226 (49) a municipality with a population of 70,000 or
227227 more but less than 150,000 that borders Joe Pool Lake;
228228 (50) a municipality with a population of 115,000 or
229229 more that borders the Neches River;
230230 (51) a municipality described by Section 351.101(k);
231231 (52) a municipality that is the county seat of a
232232 county:
233233 (A) through which the Brazos River flows; and
234234 (B) in which a national monument is located;
235235 (53) a municipality with a population of 45,000 or
236236 more that:
237237 (A) is not the county seat of a county;
238238 (B) is located in a single county; and
239239 (C) contains a portion of Lake Lewisville;
240240 (54) a municipality that is the county seat of a county
241241 with a population of more than 900,000 that is adjacent to two
242242 counties, each of which has a population of more than 1.8 million;
243243 (55) a municipality that hosts an annual wine festival
244244 and is located in three counties, each of which has a population of
245245 more than 900,000;
246246 (56) a municipality that has a population of at least
247247 150,000 but less than 1,300,000 and is partially located in a county
248248 that contains a portion of Cedar Creek Reservoir;
249249 (57) a municipality that is located in a county that
250250 contains a portion of Cedar Creek Reservoir and in which a private
251251 college is located;
252252 (58) a municipality that is the county seat of a
253253 county:
254254 (A) with a population of one million or more;
255255 (B) in which all or part of a municipality with a
256256 population of one million or more is located; and
257257 (C) that is located adjacent to a county with a
258258 population of 2.5 million or more;
259259 (59) a municipality that is the county seat of a county
260260 that contains a portion of Cedar Creek Reservoir and borders a
261261 county with a population of more than 240,000;
262262 (60) a municipality with a population of more than
263263 80,000 but less than 150,000 that is located in a county with a
264264 population of more than 369,000 but less than 864,000 that contains
265265 part of an active duty United States Army installation;
266266 (61) a municipality with a population of 750,000 or
267267 more that is located in a county with a population of 1.5 million or
268268 less;
269269 (62) a municipality with a population of less than
270270 7,000 that contains a country music hall of fame;
271271 (63) a municipality with a population of 35,000 or
272272 more that contains a railroad museum and is located in a county
273273 that:
274274 (A) has a population of 800,000 or more; and
275275 (B) is adjacent to a county with a population of
276276 four million or more; [and]
277277 (64) a municipality:
278278 (A) that is the county seat of a county:
279279 (i) with a population of 60,000 or less; and
280280 (ii) that borders the Rio Grande; and
281281 (B) in which is located a United States military
282282 fort listed in the National Register of Historic Places; and
283283 (65) a municipality with a population of 15,000 or
284284 more but less than 30,000, that is bisected by United States Highway
285285 75, and that is wholly located in a county:
286286 (A) with a population of 750,000 or more;
287287 (B) in which all or part of a municipality with a
288288 population of one million or more is located; and
289289 (C) that is adjacent to a county with a
290290 population of two million or more.
291291 SECTION 2. This Act takes effect immediately if it receives
292292 a vote of two-thirds of all the members elected to each house, as
293293 provided by Section 39, Article III, Texas Constitution. If this
294294 Act does not receive the vote necessary for immediate effect, this
295295 Act takes effect September 1, 2025.
