77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the applicability of certain immunity and liability
1010 laws to certain charter school campuses or programs.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 12.057(c), Education Code, is amended to
1313 read as follows:
1414 (c) A campus or program granted a charter under Section
1515 12.052, 12.0521(a)(1), or 12.053 is immune from liability to the
1616 same extent as a school district, and its employees and volunteers
1717 are immune from liability to the same extent as school district
1818 employees and volunteers. A member of the governing body of the
1919 campus or program is immune from liability and suit to the same
2020 extent as a school district trustee.
2121 SECTION 2. Subchapter G, Chapter 12, Education Code, is
2222 amended by adding Section 12.2525 to read as follows:
2323 Sec. 12.2525. IMMUNITY FROM LIABILITY AND SUIT. In matters
2424 related to the operation of an adult education program under a
2525 charter granted under this subchapter, an eligible entity is immune
2626 from liability and suit to the same extent as a school district, and
2727 its employees and volunteers are immune from liability and suit to
2828 the same extent as school district employees and volunteers. A
2929 member of the governing body of the entity is immune from liability
3030 and suit to the same extent as a school district trustee.
3131 SECTION 3. This Act takes effect immediately if it receives
3232 a vote of two-thirds of all the members elected to each house, as
3333 provided by Section 39, Article III, Texas Constitution. If this
3434 Act does not receive the vote necessary for immediate effect, this
3535 Act takes effect September 1, 2025.
