| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 12.057(c), Education Code, is amended to |
|---|
| 13 | 13 | | read as follows: |
|---|
| 14 | 14 | | (c) A campus or program granted a charter under Section |
|---|
| 15 | 15 | | 12.052, 12.0521(a)(1), or 12.053 is immune from liability to the |
|---|
| 16 | 16 | | same extent as a school district, and its employees and volunteers |
|---|
| 17 | 17 | | are immune from liability to the same extent as school district |
|---|
| 18 | 18 | | employees and volunteers. A member of the governing body of the |
|---|
| 19 | 19 | | campus or program is immune from liability and suit to the same |
|---|
| 20 | 20 | | extent as a school district trustee. |

| 21 | 21 | | SECTION 2. Subchapter G, Chapter 12, Education Code, is |
|---|
| 22 | 22 | | amended by adding Section 12.2525 to read as follows: |
|---|
| 23 | 23 | | Sec. 12.2525. IMMUNITY FROM LIABILITY AND SUIT. In matters |
|---|
| 24 | 24 | | related to the operation of an adult education program under a |
|---|
| 25 | 25 | | charter granted under this subchapter, an eligible entity is immune |
|---|
| 26 | 26 | | from liability and suit to the same extent as a school district, and |
|---|
| 27 | 27 | | its employees and volunteers are immune from liability and suit to |
|---|
| 28 | 28 | | the same extent as school district employees and volunteers. A |
|---|
| 29 | 29 | | member of the governing body of the entity is immune from liability |
|---|
| 30 | 30 | | and suit to the same extent as a school district trustee. |
|---|
| 31 | 31 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 32 | 32 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 33 | 33 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 34 | 34 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 35 | 35 | | Act takes effect September 1, 2025. |
