11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Article 45A.260, Code of Criminal Procedure, is | |
13 | 13 | amended to read as follows: | |
14 | 14 | Art. 45A.260. APPEARANCE BY TELEPHONE OR VIDEOCONFERENCE. | |
15 | 15 | If the justice or judge determines that requiring a defendant to | |
16 | 16 | appear before the justice or judge in person for a hearing [under | |
17 | 17 | Article 45A.258 or 45A.259] would impose an undue hardship on the | |
18 | 18 | defendant, the justice or judge may allow the defendant to appear by | |
19 | 19 | telephone or videoconference. | |
20 | 20 | SECTION 2. Article 45A.260, Code of Criminal Procedure, as | |
21 | 21 | amended by this Act, applies to a proceeding that commences before, | |
22 | 22 | on, or after the effective date of this Act. | |
23 | 23 | SECTION 3. This Act takes effect September 1, 2025. |
