| 9 | 9 | | relating to the responsibility for providing law enforcement and |

| 10 | 10 | | public safety services in the Capitol Complex. |

| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. This Act may be cited as the Texas Capitol Public |
|---|
| 13 | 13 | | Safety Protection Act. |
|---|
| 14 | 14 | | SECTION 2. Section 411.061(a), Government Code, is amended |
|---|
| 15 | 15 | | to read as follows: |
|---|
| 16 | 16 | | (a) In this subchapter, "Capitol Complex" means the |
|---|
| 17 | 17 | | following property that is located in Austin, Texas, to the extent |
|---|
| 18 | 18 | | the property is owned by or under the control of the state: |
|---|
| 19 | 19 | | (1) the area bounded on the north by the inside curb of |
|---|
| 20 | 20 | | Martin Luther King, Jr., Boulevard, on the east by the outside curb |
|---|
| 21 | 21 | | of Trinity Street, on the south by the outside curb of 10th Street, |
|---|
| 22 | 22 | | and on the west by the outside curb of Lavaca Street; |
|---|
| 23 | 23 | | (2) the William P. Clements State Office Building |
|---|
| 24 | 24 | | located at 300 West 15th Street; [and] |
|---|
| 25 | 25 | | (3) the area bounded on the north by the outside curb |
|---|
| 26 | 26 | | of 10th Street as described in Subdivision (1), on the east by the |
|---|
| 27 | 27 | | outside curb of Brazos Street, on the south by Lady Bird Lake, and |
|---|
| 28 | 28 | | on the west by the outside curb of Colorado Street; and |
|---|
| 29 | 29 | | (4) other locations [under the jurisdiction of the |
|---|
| 30 | 30 | | capitol police district] as may be approved by the commission |
|---|
| 31 | 31 | | [director]. |
|---|
| 32 | 32 | | SECTION 3. Section 411.062, Government Code, is amended by |
|---|
| 33 | 33 | | amending Subsections (a), (d-1), and (f) and adding Subsection |
|---|
| 34 | 34 | | (f-1) to read as follows: |
|---|
| 35 | 35 | | (a) The department has primary responsibility for law |
|---|
| 36 | 36 | | enforcement and security services within the boundaries of [on] the |
|---|
| 37 | 37 | | Capitol Complex. |
|---|
| 38 | 38 | | (d-1) The director shall adopt rules governing the use of |
|---|
| 39 | 39 | | unmanned aircraft in the Capitol Complex. The rules adopted under |
|---|
| 40 | 40 | | this subsection may: |
|---|
| 41 | 41 | | (1) prohibit the use of unmanned aircraft in |
|---|
| 42 | 42 | | designated areas of the Capitol Complex; or |
|---|
| 43 | 43 | | (2) authorize limited use of unmanned aircraft in |
|---|
| 44 | 44 | | designated areas of the Capitol Complex. |
|---|
| 45 | 45 | | (f) The department and the City of Austin shall execute an |
|---|
| 46 | 46 | | interlocal cooperation agreement that defines the respective |
|---|
| 47 | 47 | | responsibilities of the department and the city for traffic and |
|---|
| 48 | 48 | | parking enforcement, public safety, and general law enforcement |
|---|
| 49 | 49 | | [security] in the Capitol Complex, including private property |
|---|
| 50 | 50 | | within the boundaries of the complex. The city shall exercise the |
|---|
| 51 | 51 | | responsibilities designated to it in the agreement subject to the |
|---|
| 52 | 52 | | direction and supervision of the department. |
|---|
| 53 | 53 | | (f-1) The agreement must include a formula for calculating |
|---|
| 54 | 54 | | the department's annual cost of providing law enforcement and |
|---|
| 55 | 55 | | public safety services in the Capitol Complex. Not later than the |
|---|
| 56 | 56 | | 30th business day after the last day of each state fiscal year, the |
|---|
| 57 | 57 | | department shall use the formula to calculate the department's cost |
|---|
| 58 | 58 | | for the preceding state fiscal year and report the cost to the |
|---|
| 59 | 59 | | comptroller. |
|---|
| 60 | 60 | | SECTION 4. Subchapter F, Chapter 321, Tax Code, is amended |
|---|
| 61 | 61 | | by adding Section 321.5027 to read as follows: |
|---|
| 62 | 62 | | Sec. 321.5027. DISTRIBUTION OF TRUST FUNDS FOR CERTAIN |
|---|
| 63 | 63 | | SERVICES IN CAPITOL COMPLEX. Notwithstanding Section 321.502, the |
|---|
| 64 | 64 | | comptroller may send to the City of Austin the city's share of taxes |
|---|
| 65 | 65 | | collected by the comptroller under this chapter during a state |
|---|
| 66 | 66 | | fiscal year only after the comptroller deducts the amount reported |
|---|
| 67 | 67 | | to the comptroller by the Department of Public Safety under Section |
|---|
| 68 | 68 | | 411.062(f-1), Government Code, and credits that deducted amount to |
|---|
| 69 | 69 | | the general revenue fund. Money credited to the general revenue |
|---|
| 70 | 70 | | fund under this subsection may be appropriated only to the |
|---|
| 71 | 71 | | Department of Public Safety. |
|---|
| 72 | 72 | | SECTION 5. Not later than the 90th day after the effective |
|---|
| 73 | 73 | | date of this Act, the Department of Public Safety and the City of |
|---|
| 74 | 74 | | Austin shall amend the agreement required by Section 411.062, |
|---|
| 75 | 75 | | Government Code, as amended by this Act, as necessary to comply with |
|---|
| 76 | 76 | | this Act. |
|---|
| 77 | 77 | | SECTION 6. This Act takes effect immediately if it receives |
|---|
| 78 | 78 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 79 | 79 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 80 | 80 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 81 | 81 | | Act takes effect September 1, 2025. |
