77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the responsibility for providing law enforcement and
1010 public safety services in the Capitol Complex.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. This Act may be cited as the Texas Capitol Public
1313 Safety Protection Act.
1414 SECTION 2. Section 411.061(a), Government Code, is amended
1515 to read as follows:
1616 (a) In this subchapter, "Capitol Complex" means the
1717 following property that is located in Austin, Texas, to the extent
1818 the property is owned by or under the control of the state:
1919 (1) the area bounded on the north by the inside curb of
2020 Martin Luther King, Jr., Boulevard, on the east by the outside curb
2121 of Trinity Street, on the south by the outside curb of 10th Street,
2222 and on the west by the outside curb of Lavaca Street;
2323 (2) the William P. Clements State Office Building
2424 located at 300 West 15th Street; [and]
2525 (3) the area bounded on the north by the outside curb
2626 of 10th Street as described in Subdivision (1), on the east by the
2727 outside curb of Brazos Street, on the south by Lady Bird Lake, and
2828 on the west by the outside curb of Colorado Street; and
2929 (4) other locations [under the jurisdiction of the
3030 capitol police district] as may be approved by the commission
3131 [director].
3232 SECTION 3. Section 411.062, Government Code, is amended by
3333 amending Subsections (a), (d-1), and (f) and adding Subsection
3434 (f-1) to read as follows:
3535 (a) The department has primary responsibility for law
3636 enforcement and security services within the boundaries of [on] the
3737 Capitol Complex.
3838 (d-1) The director shall adopt rules governing the use of
3939 unmanned aircraft in the Capitol Complex. The rules adopted under
4040 this subsection may:
4141 (1) prohibit the use of unmanned aircraft in
4242 designated areas of the Capitol Complex; or
4343 (2) authorize limited use of unmanned aircraft in
4444 designated areas of the Capitol Complex.
4545 (f) The department and the City of Austin shall execute an
4646 interlocal cooperation agreement that defines the respective
4747 responsibilities of the department and the city for traffic and
4848 parking enforcement, public safety, and general law enforcement
4949 [security] in the Capitol Complex, including private property
5050 within the boundaries of the complex. The city shall exercise the
5151 responsibilities designated to it in the agreement subject to the
5252 direction and supervision of the department.
5353 (f-1) The agreement must include a formula for calculating
5454 the department's annual cost of providing law enforcement and
5555 public safety services in the Capitol Complex. Not later than the
5656 30th business day after the last day of each state fiscal year, the
5757 department shall use the formula to calculate the department's cost
5858 for the preceding state fiscal year and report the cost to the
5959 comptroller.
6060 SECTION 4. Subchapter F, Chapter 321, Tax Code, is amended
6161 by adding Section 321.5027 to read as follows:
6262 Sec. 321.5027. DISTRIBUTION OF TRUST FUNDS FOR CERTAIN
6363 SERVICES IN CAPITOL COMPLEX. Notwithstanding Section 321.502, the
6464 comptroller may send to the City of Austin the city's share of taxes
6565 collected by the comptroller under this chapter during a state
6666 fiscal year only after the comptroller deducts the amount reported
6767 to the comptroller by the Department of Public Safety under Section
6868 411.062(f-1), Government Code, and credits that deducted amount to
6969 the general revenue fund. Money credited to the general revenue
7070 fund under this subsection may be appropriated only to the
7171 Department of Public Safety.
7272 SECTION 5. Not later than the 90th day after the effective
7373 date of this Act, the Department of Public Safety and the City of
7474 Austin shall amend the agreement required by Section 411.062,
7575 Government Code, as amended by this Act, as necessary to comply with
7676 this Act.
7777 SECTION 6. This Act takes effect immediately if it receives
7878 a vote of two-thirds of all the members elected to each house, as
7979 provided by Section 39, Article III, Texas Constitution. If this
8080 Act does not receive the vote necessary for immediate effect, this
8181 Act takes effect September 1, 2025.
