| 8 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 11 | | SECTION 1. Section 523.0102(a), Government Code, is amended |
|---|
| 10 | 12 | | by amending Subsection (a)(1) to read as follows: |
|---|
| 11 | 13 | | (a) The executive council shall seek and receive public |
|---|
| 12 | 14 | | comment on: |
|---|
| 13 | 15 | | (1) commission rulemaking activities [proposed |
|---|
| 14 | 16 | | rules]; |
|---|
| 15 | 17 | | (2) advisory committee recommendations; |
|---|
| 16 | 18 | | (3) legislative appropriations requests or other |
|---|
| 17 | 19 | | documents related to the appropriations process; |
|---|
| 18 | 20 | | (4) the operation of health and human services |
|---|
| 19 | 21 | | programs; and |
|---|
| 20 | 22 | | (5) other items the executive commissioner determines |
|---|
| 21 | 23 | | appropriate. |
|---|
| 22 | 24 | | SECTION 2. Section 523.0103(a), Government Code, is amended |
|---|
| 23 | 25 | | by amending Subsection (a)(2) to read as follows: |
|---|
| 24 | 26 | | (a) The executive council is composed of: |
|---|
| 25 | 27 | | (1) the executive commissioner; |
|---|
| 26 | 28 | | (2) the director of each division established by the |
|---|
| 27 | 29 | | executive commissioner [established under former Section |
|---|
| 28 | 30 | | 531.008(c) before the expiration of that subsection on September 1, |
|---|
| 29 | 31 | | 2023]; |
|---|
| 30 | 32 | | (3) the commissioner of a health and human services |
|---|
| 31 | 33 | | agency; |
|---|
| 32 | 34 | | (4) the commissioner of the Department of Family and |
|---|
| 33 | 35 | | Protective Services, regardless of whether that agency continues as |
|---|
| 34 | 36 | | a state agency separate from the commission; and |
|---|
| 35 | 37 | | (5) other individuals the executive commissioner |
|---|
| 36 | 38 | | appoints as the executive commissioner determines necessary. |
|---|
| 37 | 39 | | SECTION 3. This Act takes effect September 1, 2025. |
