77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the confidentiality of information used to prevent,
1010 detect, respond to, or investigate a hostile act of a foreign
1111 adversary of the United States.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 418.176(a), Government Code, is amended
1414 to read as follows:
1515 (a) Information is confidential if the information is
1616 collected, assembled, or maintained by or for a governmental entity
1717 for the purpose of preventing, detecting, responding to, or
1818 investigating an act of terrorism or related criminal activity or a
1919 hostile act by a foreign adversary of the United States and:
2020 (1) relates to the staffing requirements of an
2121 emergency response provider, including a law enforcement agency, a
2222 fire-fighting agency, or an emergency services agency;
2323 (2) relates to a tactical plan of the provider; or
2424 (3) consists of a list or compilation of pager or
2525 telephone numbers, including mobile and cellular telephone
2626 numbers, of the provider.
2727 SECTION 2. Section 418.177, Government Code, is amended to
2828 read as follows:
2929 Sec. 418.177. CONFIDENTIALITY OF CERTAIN INFORMATION
3030 RELATING TO RISK OR VULNERABILITY ASSESSMENT. Information is
3131 confidential if the information:
3232 (1) is collected, assembled, or maintained by or for a
3333 governmental entity for the purpose of preventing, detecting, or
3434 investigating an act of terrorism or related criminal activity or a
3535 hostile act by a foreign adversary of the United States; and
3636 (2) relates to an assessment by or for a governmental
3737 entity, or an assessment that is maintained by a governmental
3838 entity, of the risk or vulnerability of persons or property,
3939 including critical infrastructure, to an act of terrorism or
4040 related criminal activity.
4141 SECTION 3. Section 418.179(a), Government Code, is amended
4242 to read as follows:
4343 (a) Information is confidential if the information:
4444 (1) is collected, assembled, or maintained by or for a
4545 governmental entity for the purpose of preventing, detecting, or
4646 investigating an act of terrorism or related criminal activity or a
4747 hostile act by a foreign adversary of the United States; and
4848 (2) relates to the details of the encryption codes or
4949 security keys for a public communications system.
5050 SECTION 4. Section 418.180, Government Code, is amended to
5151 read as follows:
5252 Sec. 418.180. CONFIDENTIALITY OF CERTAIN INFORMATION
5353 PREPARED FOR UNITED STATES. Information, other than financial
5454 information, in the possession of a governmental entity is
5555 confidential if the information:
5656 (1) is part of a report to an agency of the United
5757 States;
5858 (2) relates to an act of terrorism or related criminal
5959 activity or a hostile act by a foreign adversary of the United
6060 States; and
6161 (3) is specifically required to be kept confidential:
6262 (A) under Section 552.101 because of a federal
6363 statute or regulation;
6464 (B) to participate in a state-federal
6565 information sharing agreement; or
6666 (C) to obtain federal funding.
6767 SECTION 5. Section 418.181, Government Code, is amended to
6868 read as follows:
6969 Sec. 418.181. CONFIDENTIALITY OF CERTAIN INFORMATION
7070 RELATING TO CRITICAL INFRASTRUCTURE. Those documents or portions
7171 of documents in the possession of a governmental entity are
7272 confidential if they identify the technical details of particular
7373 vulnerabilities of critical infrastructure to an act of terrorism
7474 or a hostile act by a foreign adversary of the United States.
7575 SECTION 6. Section 418.182(a), Government Code, is amended
7676 to read as follows:
7777 (a) Except as provided by Subsections (b) and (c),
7878 information, including access codes and passwords, in the
7979 possession of a governmental entity is confidential if the
8080 information [that] relates to the specifications, operating
8181 procedures, or location of a security system used to protect public
8282 or private property from an act of terrorism or related criminal
8383 activity or a hostile act by a foreign adversary of the United
8484 States [is confidential].
8585 SECTION 7. This Act takes effect immediately if it receives
8686 a vote of two-thirds of all the members elected to each house, as
8787 provided by Section 39, Article III, Texas Constitution. If this
8888 Act does not receive the vote necessary for immediate effect, this
8989 Act takes effect September 1, 2025.
