7 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

8 | 10 | | SECTION 1. Section 16.073, Subchapter D, Chapter 16, Civil |

9 | 11 | | Practice and Remedies Code, is amended by striking Subsections (a) |

10 | 12 | | and (b) and substituting the following: |

11 | 13 | | Sec. 16.073. APPLICABILITY OF LIMITATIONS PERIODS TO |

12 | 14 | | ARBITRATION. A claim sought to be arbitrated is subject to the same |
---|
13 | 15 | | limitations of time for the commencement of actions as if the claims |
---|
14 | 16 | | had been asserted in a court. Commencing an action by filing suit |
---|
15 | 17 | | in a court of competent jurisdiction will serve to toll limitations |
---|
16 | 18 | | of time for binding arbitration of the same action. |
---|
17 | 19 | | SECTION 2. This Act takes effect immediately if it receives |
---|
18 | 20 | | a vote of two-thirds of all the members elected to each house, as |
---|
19 | 21 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
20 | 22 | | Act does not receive the vote necessary for immediate effect, this |
---|
21 | 23 | | Act takes effect on the 91st day after the last day of the |
---|
22 | 24 | | legislative session. |
