57 AN ACT
68 relating to amending the Texas General Arbitration Act.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Section 16.073, Subchapter D, Chapter 16, Civil
911 Practice and Remedies Code, is amended by striking Subsections (a)
1012 and (b) and substituting the following:
1113 Sec. 16.073. APPLICABILITY OF LIMITATIONS PERIODS TO
1214 ARBITRATION. A claim sought to be arbitrated is subject to the same
1315 limitations of time for the commencement of actions as if the claims
1416 had been asserted in a court. Commencing an action by filing suit
1517 in a court of competent jurisdiction will serve to toll limitations
1618 of time for binding arbitration of the same action.
1719 SECTION 2. This Act takes effect immediately if it receives
1820 a vote of two-thirds of all the members elected to each house, as
1921 provided by Section 39, Article III, Texas Constitution. If this
2022 Act does not receive the vote necessary for immediate effect, this
2123 Act takes effect on the 91st day after the last day of the
2224 legislative session.
