77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the punishment for assault for certain persons subject
1010 to an emergency detention or commitment for mental health services.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 22.01, Penal Code, is amended by adding
1313 Subsection (b-5) to read as follows:
1414 (b-5) The increase in punishment provided by Subsection
1515 (b)(1), (4), (5), or (9) does not apply if the offense is committed
1616 by an actor:
1717 (1) who is being apprehended or detained pursuant to
1818 an order for emergency detention under Chapter 573, Health and
1919 Safety Code; or
2020 (2) for whom an application for court-ordered mental
2121 health services is pending or who is currently committed to a
2222 facility for inpatient mental health services under Chapter 574,
2323 Health and Safety Code.
2424 SECTION 2. The change in law made by this Act applies only
2525 to an offense committed on or after the effective date of this Act.
2626 An offense committed before the effective date of this Act is
2727 governed by the law in effect on the date the offense was committed,
2828 and the former law is continued in effect for that purpose. For
2929 purposes of this section, an offense was committed before the
3030 effective date of this Act if any element of the offense occurred
3131 before that date.
3232 SECTION 3. This Act takes effect September 1, 2025.
