77 AN ACT
88 relating to the sale of fireworks for the Fourth of July holiday
99 celebration season.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 2154.202, Occupations Code, is amended
1212 by amending Subsections (g) (1) to read as follows:
1313 (g) Except as provided by Subsection (h), a retail fireworks
1414 permit holder may sell fireworks only to the public, and only during
1515 periods:
1616 (1) beginning June 24 and ending at midnight on Sunday
1717 of the weekend following July 4, if July 4 is on a weekday. If July
1818 4 is on a weekend the period ends at midnight on July 4;
1919 SECTION 2. This Act takes effect immediately if it receives
2020 a vote of two-thirds of all the members elected to each house, as
2121 provided by Section 39, Article III, Texas Constitution. If this
2222 Act does not receive the vote necessary for immediate effect, this
2323 Act takes effect September 1, 2025.
