88 AN ACT
99 relating to prohibiting the use of environmental, social, or
1010 governance scores; providing a civil penalty.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subtitle A, Title 5, Business & Commerce Code, is
1313 amended by adding Chapter 75 to read as follows:
1414 CHAPTER 75. PROHIBITED USE OF CERTAIN CREDIT SCORES
1515 Sec. 75.0001. DEFINITIONS. In this chapter:
1616 (1) "Credit score" means a number or rating derived
1717 from an algorithm, computer application, model, or other process
1818 that is based on information related to a customer and used to
1919 determine a customer's creditworthiness or credit capacity.
2020 (2) "Environmental, social, or governance score"
2121 means a credit score that is based on measuring a customer's
2222 exposure to long-term environmental, social, and governance risks.
2323 Sec. 75.0002. USE OF CERTAIN CREDIT SCORES PROHIBITED. A
2424 person that conducts business in this state may not assign an
2525 environmental, social, or governance score to an individual or
2626 family that resides in this state.
2727 Sec. 75.0003. CIVIL PENALTY; INJUNCTION. (a) A person that
2828 violates Section 75.0002 is liable to this state for a civil penalty
2929 in an amount not to exceed $1,000 for each individual or family that
3030 resides in this state to whom the person assigns an environmental,
3131 social, or governance score. Each day a violation continues is a
3232 separate violation for purposes of a civil penalty assessment.
3333 (b) The attorney general may bring an action:
3434 (1) to collect a civil penalty imposed under this
3535 section; and
3636 (2) in the name of this state to enjoin a violation of
3737 this chapter.
3838 (c) The attorney general is entitled to recover reasonable
3939 expenses incurred in bringing an action under this section,
4040 including reasonable attorney's fees and court costs.
4141 SECTION 2. This Act takes effect September 1, 2025.
