57 AN ACT
68 relating to the civil liability of nonprofit entities.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Chapter 84, Civil Practice and Remedies Code, is
911 amended by adding Section 84.0068 to read as follows:
1012 Sec. 84.0068. LIABILITY OF SINGLE SOURCE CONTINUUM
1113 CONTRACTORS OR CERTAIN NONPROFIT ENTITIES PROVIDING FOSTER CARE OR
1214 ADOPTION SERVICES. (a) Subject to Subsection (b) and except as
1315 provided by Subsection (c), an entity described by Section
1416 264.170(a), Family Code, may not be held liable for damages in
1517 excess of the amounts provided by Section 84.006 for any act or
1618 omission by a person who is an employee or volunteer of the entity
1719 or a caregiver or clinical professional providing services to the
1820 entity if, for each person, the entity has:
1921 (1) conducted timely criminal background checks as
2022 required by law;
2123 (2) before hiring, contracting with, or otherwise
2224 enlisting the services of the person and then at least once every
2325 five years, confirmed the person is not listed in a state registry
2426 or database that indicates the person is ineligible to supervise or
2527 treat children;
2628 (3) reported any known allegation of misconduct by the
2729 person as required by law;
2830 (4) taken appropriate administrative or personnel
2931 action in response to misconduct by the person; and
3032 (5) required the person to complete training for:
3133 (A) child sexual abuse prevention at least once
3234 every five years; and
3335 (B) the reporting of child abuse and neglect.
3436 (b) An entity described by Section 264.170(a), Family Code,
3537 may only be held vicariously liable by a claimant for the act or
3638 omission of a person who is an employee or volunteer of the entity
3739 or a caregiver or clinical professional providing services to the
3840 entity if the claimant shows:
3941 (1) the entity was not in substantial compliance with
4042 a requirement described by Subsection (a);
4143 (2) the requirement was designed to prevent the
4244 specific type of harm alleged to have occurred; and
4345 (3) the entity's failure to be in substantial
4446 compliance with the requirement was a substantial factor in
4547 bringing about the harm.
4648 (c) Subsection (a) does not affect the liability of an
4749 entity described by Section 264.170(a), Family Code, arising from
4850 an act or omission by the entity that constitutes gross negligence.
4951 SECTION 2. Section 264.170, Family Code, is amended to read
5052 as follows:
5153 Sec. 264.170. LIMITED LIABILITY FOR SINGLE SOURCE CONTINUUM
5254 CONTRACTOR OR NONPROFIT ENTITY CONTRACTED TO PROVIDE FOSTER CARE OR
5355 ADOPTION SERVICES AND RELATED PERSONNEL. (a) A nonprofit entity
5456 that contracts with the department to provide services as a single
5557 source continuum contractor under this subchapter or a nonprofit
5658 entity that contracts with the state or a single source continuum
5759 contractor to provide foster care or adoption services is
5860 considered to be a charitable organization for the purposes of
5961 Chapter 84, Civil Practice and Remedies Code, with respect to the
6062 provision of those services, and that chapter applies to the entity
6163 and any person who is:
6264 (1) an employee or volunteer of the entity; or
6365 (2) a caregiver or clinical professional providing
6466 services to the entity.
6567 (b) The limitations on liability provided by this section
6668 apply:
6769 (1) only to an act or omission by the entity or person,
6870 as applicable, that occurs:
6971 (A) while the entity or person is acting within
7072 the course and scope of the entity's contract with the department or
7173 a single source continuum contractor; or
7274 (B) while the person is acting within the course
7375 and scope of [and] the person's duties for the entity; and
7476 (2) only if insurance coverage in the minimum amounts
7577 required by Chapter 84, Civil Practice and Remedies Code, is in
7678 force and effect at the time a cause of action for personal injury,
7779 death, or property damage accrues.
7880 SECTION 3. Section 84.0068, Civil Practice and Remedies
7981 Code, as added by this Act, and Section 264.170, Family Code, as
8082 amended by this Act, apply only to a cause of action that accrues on
8183 or after the effective date of this Act. A cause of action that
8284 accrued before the effective date of this Act is governed by the law
8385 as it existed immediately before the effective date of this Act, and
8486 that law is continued in effect for that purpose.
8587 SECTION 4. This Act takes effect September 1, 2025.
