77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the prohibited provision of homeless services in
1010 certain locations.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subtitle A, Title 9, Health and Safety Code, is
1313 amended by adding Chapter 763 to read as follows:
1414 CHAPTER 763. HOMELESS SERVICES
1515 Sec. 763.001. DEFINITIONS. In this chapter:
1616 (1) "Homeless services" means services intended
1717 primarily to benefit individuals experiencing homelessness. The
1818 term includes services for shelter, medical care, meals, drug
1919 rehabilitation, job training, financial assistance, and mental
2020 health treatment.
2121 (2) "Organization" has the meaning assigned by Section
2222 1.201, Business & Commerce Code.
2323 (3) "Political subdivision" means a county,
2424 municipality, school district, junior college district, other
2525 special district, or other subdivision of state government.
2626 (4) "Residential area" has the meaning assigned by
2727 Section 341.0358.
2828 Sec. 763.002. APPLICABILITY. This chapter does not apply
2929 to the provision of services at an overnight shelter for
3030 individuals experiencing homelessness.
3131 Sec. 763.003. SERVICES PROHIBITED IN CERTAIN LOCATIONS. An
3232 organization may not provide homeless services within 1,000 feet
3333 of:
3434 (1) a public or private primary or secondary school
3535 campus;
3636 (2) a residential area; or
3737 (3) a public park.
3838 Sec. 763.004. VIOLATION; INELIGIBILITY FOR CERTAIN
3939 LICENSES. An organization that violates Section 763.003 is
4040 ineligible to obtain a license, permit, certificate, or other
4141 authorization necessary to operate or conduct business in this
4242 state issued by a state agency or political subdivision.
4343 SECTION 2. This Act takes effect September 1, 2025.
