11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Subtitle A, Title 9, Health and Safety Code, is |
---|
13 | 13 | | amended by adding Chapter 763 to read as follows: |
---|
14 | 14 | | CHAPTER 763. HOMELESS SERVICES |
---|
15 | 15 | | Sec. 763.001. DEFINITIONS. In this chapter: |
---|
16 | 16 | | (1) "Homeless services" means services intended |
---|
17 | 17 | | primarily to benefit individuals experiencing homelessness. The |
---|
18 | 18 | | term includes services for shelter, medical care, meals, drug |
---|
19 | 19 | | rehabilitation, job training, financial assistance, and mental |
---|
20 | 20 | | health treatment. |
---|
21 | 21 | | (2) "Organization" has the meaning assigned by Section |
---|
22 | 22 | | 1.201, Business & Commerce Code. |
---|
23 | 23 | | (3) "Political subdivision" means a county, |
---|
24 | 24 | | municipality, school district, junior college district, other |
---|
25 | 25 | | special district, or other subdivision of state government. |
---|
26 | 26 | | (4) "Residential area" has the meaning assigned by |
---|
27 | 27 | | Section 341.0358. |
---|
28 | 28 | | Sec. 763.002. APPLICABILITY. This chapter does not apply |
---|
29 | 29 | | to the provision of services at an overnight shelter for |
---|
30 | 30 | | individuals experiencing homelessness. |
---|
31 | 31 | | Sec. 763.003. SERVICES PROHIBITED IN CERTAIN LOCATIONS. An |
---|
32 | 32 | | organization may not provide homeless services within 1,000 feet |
---|
33 | 33 | | of: |
---|
34 | 34 | | (1) a public or private primary or secondary school |
---|
35 | 35 | | campus; |
---|
36 | 36 | | (2) a residential area; or |
---|
37 | 37 | | (3) a public park. |
---|
38 | 38 | | Sec. 763.004. VIOLATION; INELIGIBILITY FOR CERTAIN |
---|
39 | 39 | | LICENSES. An organization that violates Section 763.003 is |
---|
40 | 40 | | ineligible to obtain a license, permit, certificate, or other |
---|
41 | 41 | | authorization necessary to operate or conduct business in this |
---|
42 | 42 | | state issued by a state agency or political subdivision. |
---|
43 | 43 | | SECTION 2. This Act takes effect September 1, 2025. |
