77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the authority of a physical therapist to treat a patient
1010 without a referral.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 453.301(a), Occupations Code, is amended
1313 to read as follows:
1414 (a) A physical therapist may treat a patient for an injury
1515 or condition in a manner described by Section 453.005 without a
1616 referral [if the physical therapist:
1717 [(1) has been licensed to practice physical therapy
1818 for at least one year;
1919 [(2) is covered by professional liability insurance in
2020 the minimum amount required by board rule; and
2121 [(3) either:
2222 [(A) possesses a doctoral degree in physical
2323 therapy from:
2424 [(i) a program that is accredited by the
2525 Commission on Accreditation in Physical Therapy Education; or
2626 [(ii) an institution that is accredited by
2727 an agency or association recognized by the United States secretary
2828 of education; or
2929 [(B) has completed at least 30 hours of
3030 continuing competence activities in the area of differential
3131 diagnosis].
3232 SECTION 2. The heading to Section 453.302, Occupations
3333 Code, is amended to read as follows:
3434 Sec. 453.302. PROVISION OF EMERGENCY MEDICAL CARE [TREATING
3535 PATIENT WITHOUT REFERRAL].
3636 SECTION 3. Section 453.302(b), Occupations Code, is amended
3737 to read as follows:
3838 (b) In an emergency circumstance, including a minor
3939 emergency, a physical therapist may provide emergency medical care
4040 to a person to the best of the therapist's ability [without a
4141 referral from a referring practitioner].
4242 SECTION 4. The following provisions of the Occupations Code
4343 are repealed:
4444 (1) Section 453.001(9);
4545 (2) Sections 453.301(a-1), (a-2), and (b); and
4646 (3) Section 453.302(c).
4747 SECTION 5. This Act takes effect September 1, 2025.
