9 | 9 | | relating to the expunction of arrest records and files and the |
---|
10 | 10 | | issuance of orders of nondisclosure of criminal history record |
---|
11 | 11 | | information for certain persons. |
---|
12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
13 | 13 | | SECTION 1. Article 55.01(c), Code of Criminal Procedure, is |
---|
14 | 14 | | amended to read as follows: |
---|
15 | 15 | | (c) A court may not order the expunction of records and |
---|
16 | 16 | | files relating to an arrest for an offense for which a person is |
---|
17 | 17 | | subsequently acquitted, whether by the trial court, a court of |
---|
18 | 18 | | appeals, or the court of criminal appeals, if the offense for which |
---|
19 | 19 | | the person was acquitted arose out of a criminal episode described |
---|
20 | 20 | | [, as defined] by Section 3.01(1) [3.01], Penal Code, and the person |
---|
21 | 21 | | was convicted of or remains subject to prosecution for at least one |
---|
22 | 22 | | other offense occurring during the criminal episode. |
---|
23 | 23 | | SECTION 2. Subchapter E-1, Chapter 411, Government Code, is |
---|
24 | 24 | | amended by adding Section 411.0717 to read as follows: |
---|
25 | 25 | | Sec. 411.0717. CERTAIN RELATED OFFENSES INCLUDED IN ORDER. |
---|
26 | 26 | | A court that issues an order of nondisclosure of criminal history |
---|
27 | 27 | | record information under this subchapter shall include in the order |
---|
28 | 28 | | any other offense arising out of the same transaction as the offense |
---|
29 | 29 | | for which the order is sought if: |
---|
30 | 30 | | (1) the other offense has not resulted in a final |
---|
31 | 31 | | conviction and is no longer pending; and |
---|
32 | 32 | | (2) there was no court-ordered community supervision |
---|
33 | 33 | | under Chapter 42A, Code of Criminal Procedure, for the other |
---|
34 | 34 | | offense. |
---|
35 | 35 | | SECTION 3. Sections 411.073(b) and (d), Government Code, |
---|
36 | 36 | | are amended to read as follows: |
---|
37 | 37 | | (b) Notwithstanding any other provision of this subchapter |
---|
38 | 38 | | or Subchapter F, a person described by Subsection (a) whose |
---|
39 | 39 | | community supervision is not revoked and who completes the period |
---|
40 | 40 | | of community supervision, including any term of confinement imposed |
---|
41 | 41 | | and payment of all fines, costs, and restitution imposed, may |
---|
42 | 42 | | petition the court that placed the person on community supervision |
---|
43 | 43 | | for an order of nondisclosure of criminal history record |
---|
44 | 44 | | information under this section if the person[: |
---|
45 | 45 | | [(1)] satisfies the requirements of this section and |
---|
46 | 46 | | Section 411.074[; and |
---|
47 | 47 | | [(2) has never been previously convicted of or placed |
---|
48 | 48 | | on deferred adjudication community supervision for another offense |
---|
49 | 49 | | other than a traffic offense that is punishable by fine only]. |
---|
50 | 50 | | (d) A person may petition the court that placed the person |
---|
51 | 51 | | on community supervision for an order of nondisclosure of criminal |
---|
52 | 52 | | history record information under this section only on or after[: |
---|
53 | 53 | | [(1)] the completion of the community supervision[, if |
---|
54 | 54 | | the offense for which the person was placed on community |
---|
55 | 55 | | supervision was a misdemeanor other than a misdemeanor described by |
---|
56 | 56 | | Subdivision (2); or |
---|
57 | 57 | | [(2) the second anniversary of the date of completion |
---|
58 | 58 | | of the community supervision, if the offense for which the person |
---|
59 | 59 | | was placed on community supervision was a misdemeanor under Chapter |
---|
60 | 60 | | 20, 21, 22, 25, 42, 43, or 46, Penal Code]. |
---|
61 | 61 | | SECTION 4. Section 411.0735(b), Government Code, is amended |
---|
62 | 62 | | to read as follows: |
---|
63 | 63 | | (b) Notwithstanding any other provision of this subchapter |
---|
64 | 64 | | or Subchapter F, a person described by Subsection (a) who completes |
---|
65 | 65 | | the person's sentence, including any term of confinement imposed |
---|
66 | 66 | | and payment of all fines, costs, and restitution imposed, may |
---|
67 | 67 | | petition the court that imposed the sentence for an order of |
---|
68 | 68 | | nondisclosure of criminal history record information under this |
---|
69 | 69 | | section if the person[: |
---|
70 | 70 | | [(1)] satisfies the requirements of this section and |
---|
71 | 71 | | Section 411.074[; and |
---|
72 | 72 | | [(2) has never been previously convicted of or placed |
---|
73 | 73 | | on deferred adjudication community supervision for another offense |
---|
74 | 74 | | other than a traffic offense that is punishable by fine only]. |
---|
75 | 75 | | SECTION 5. Article 55.01(c), Code of Criminal Procedure, as |
---|
76 | 76 | | amended by this Act, applies to the expunction of arrest records and |
---|
77 | 77 | | files for any criminal offense that occurred before, on, or after |
---|
78 | 78 | | the effective date of this Act. |
---|
79 | 79 | | SECTION 6. This Act takes effect September 1, 2025. |
