77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the issuance of a single license for a hospital and a
1010 mobile stroke unit of the hospital.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 241.023, Health and Safety Code, is
1313 amended by amending Subsections (c-1) and (c-2) and adding
1414 Subsection (h) to read as follows:
1515 (c-1) The department may issue:
1616 (1) one license for multiple hospitals if:
1717 (A) [(1)] all buildings in which inpatients
1818 receive hospital services and inpatient services of each of the
1919 hospitals to be included in the license are subject to the control
2020 and direction of the same governing body;
2121 (B) [(2)] all buildings in which inpatients
2222 receive hospital services are within a 30-mile radius of the main
2323 address of the applicant;
2424 (C) [(3)] there is integration of the organized
2525 medical staff of each of the hospitals to be included in the
2626 license;
2727 (D) [(4)] there is a single chief executive
2828 officer for all of the hospitals who reports directly to the
2929 governing body and through whom all administrative authority flows
3030 and who exercises control and surveillance over all administrative
3131 activities of the hospital;
3232 (E) [(5)] there is a single chief medical officer
3333 for all of the hospitals who reports directly to the governing body
3434 and who is responsible for all medical staff activities of the
3535 hospital;
3636 (F) [(6)] each building of a hospital to be
3737 included in the license that is geographically separate from other
3838 buildings of the same hospital contains at least one nursing unit
3939 for inpatients, unless providing only diagnostic or laboratory
4040 services, or a combination of diagnostic or laboratory services, in
4141 the building for hospital inpatients; and
4242 (G) [(7)] each hospital that is to be included in
4343 the license complies with the emergency services standards:
4444 (i) [(A)] for a general hospital, if the
4545 hospital provides surgery or obstetrical care or both; or
4646 (ii) [(B)] for a special hospital, if the
4747 hospital does not provide surgery or obstetrical care; and
4848 (2) one license for a hospital and a mobile stroke unit
4949 of the hospital if the mobile stroke unit is accredited by a health
5050 care accreditation organization approved by the Centers for
5151 Medicare and Medicaid Services.
5252 (c-2) The department may recommend a waiver of the
5353 requirement of Subsection (c-1)(1)(G) [(c-1)(7)] for a hospital if
5454 another hospital that is to be included in the license:
5555 (1) complies with the emergency services standards for
5656 a general hospital; and
5757 (2) is in close geographic proximity to the hospital.
5858 (h) Subsection (g) does not apply to a license issued to a
5959 mobile stroke unit of a hospital under Subsection (c-1)(2).
6060 SECTION 2. As soon as practicable after the effective date
6161 of this Act, the executive commissioner of the Health and Human
6262 Services Commission shall adopt rules necessary to implement
6363 Section 241.023(c-1), Health and Safety Code, as amended by this
6464 Act.
6565 SECTION 3. This Act takes effect September 1, 2025.
