7	7	A BILL TO BE ENTITLED
8	8	AN ACT
9	9	relating to the issuance of a single license for a hospital and a
10	10	mobile stroke unit of the hospital.
11	11	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	12	SECTION 1. Section 241.023, Health and Safety Code, is
13	13	amended by amending Subsections (c-1) and (c-2) and adding
14	14	Subsection (h) to read as follows:
15	15	(c-1) The department may issue:
16	16	(1) one license for multiple hospitals if:
17	17	(A) [(1)] all buildings in which inpatients
18	18	receive hospital services and inpatient services of each of the
19	19	hospitals to be included in the license are subject to the control
20	20	and direction of the same governing body;
21	21	(B) [(2)] all buildings in which inpatients
22	22	receive hospital services are within a 30-mile radius of the main
23	23	address of the applicant;
24	24	(C) [(3)] there is integration of the organized
25	25	medical staff of each of the hospitals to be included in the
26	26	license;
27	27	(D) [(4)] there is a single chief executive
28	28	officer for all of the hospitals who reports directly to the
29	29	governing body and through whom all administrative authority flows
30	30	and who exercises control and surveillance over all administrative
31	31	activities of the hospital;
32	32	(E) [(5)] there is a single chief medical officer
33	33	for all of the hospitals who reports directly to the governing body
34	34	and who is responsible for all medical staff activities of the
35	35	hospital;
36	36	(F) [(6)] each building of a hospital to be
37	37	included in the license that is geographically separate from other
38	38	buildings of the same hospital contains at least one nursing unit
39	39	for inpatients, unless providing only diagnostic or laboratory
40	40	services, or a combination of diagnostic or laboratory services, in
41	41	the building for hospital inpatients; and
42	42	(G) [(7)] each hospital that is to be included in
43	43	the license complies with the emergency services standards:
44	44	(i) [(A)] for a general hospital, if the
45	45	hospital provides surgery or obstetrical care or both; or
46	46	(ii) [(B)] for a special hospital, if the
47	47	hospital does not provide surgery or obstetrical care; and
48	48	(2) one license for a hospital and a mobile stroke unit
49	49	of the hospital if the mobile stroke unit is accredited by a health
50	50	care accreditation organization approved by the Centers for
51	51	Medicare and Medicaid Services.
52	52	(c-2) The department may recommend a waiver of the
53	53	requirement of Subsection (c-1)(1)(G) [(c-1)(7)] for a hospital if
54	54	another hospital that is to be included in the license:
55	55	(1) complies with the emergency services standards for
56	56	a general hospital; and
57	57	(2) is in close geographic proximity to the hospital.
58	58	(h) Subsection (g) does not apply to a license issued to a
59	59	mobile stroke unit of a hospital under Subsection (c-1)(2).
60	60	SECTION 2. As soon as practicable after the effective date
61	61	of this Act, the executive commissioner of the Health and Human
62	62	Services Commission shall adopt rules necessary to implement
63	63	Section 241.023(c-1), Health and Safety Code, as amended by this
64	64	Act.
65	65	SECTION 3. This Act takes effect September 1, 2025.
