77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to academic distinction designations under the public
1010 school accountability system and the career and technology
1111 allotment under the Foundation School Program.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 39.202, Education Code, is amended to
1414 read as follows:
1515 Sec. 39.202. ACADEMIC DISTINCTION DESIGNATION FOR
1616 DISTRICTS AND CAMPUSES. The commissioner by rule shall establish
1717 an academic distinction designation for districts and campuses for
1818 outstanding performance in attainment of postsecondary readiness.
1919 The commissioner shall adopt criteria for the designation under
2020 this section, including:
2121 (1) percentages of students who:
2222 (A) performed satisfactorily, as determined
2323 under the college readiness performance standard under Section
2424 39.0241, on assessment instruments required under Section
2525 39.023(a), (b), (c), or (l), aggregated across grade levels by
2626 subject area; or
2727 (B) met the standard for annual improvement, as
2828 determined by the agency under Section 39.034, on assessment
2929 instruments required under Section 39.023(a), (b), (c), or (l),
3030 aggregated across grade levels by subject area, for students who
3131 did not perform satisfactorily as described by Paragraph (A);
3232 (2) percentages of:
3333 (A) students who earned a nationally or
3434 internationally recognized business or industry certification or
3535 license;
3636 (B) students who completed a coherent sequence of
3737 career and technical courses;
3838 (C) students who completed a dual credit course
3939 or an articulated postsecondary course provided for local credit;
4040 (D) students who achieved applicable College
4141 Readiness Benchmarks or the equivalent on the Preliminary
4242 Scholastic Assessment Test (PSAT), the Scholastic Assessment Test
4343 (SAT), the American College Test (ACT), or the ACT-Plan assessment
4444 program; [and]
4545 (E) students who received a score on either an
4646 advanced placement test or an international baccalaureate
4747 examination to be awarded college credit; and
4848 (F) students who completed a Pathways in
4949 Technology Early College High School (P-TECH) program established
5050 under Subchapter N, Chapter 29, or another early college high
5151 school program; and
5252 (3) other factors for determining sufficient student
5353 attainment of postsecondary readiness.
5454 SECTION 2. Section 48.106(a-1), Education Code, is amended
5555 to read as follows:
5656 (a-1) In addition to the amounts under Subsection (a), for
5757 each student in average daily attendance enrolled at a campus
5858 designated as a P-TECH school under Section 29.556, a district is
5959 entitled to $150 [$50 for each of the following in which the student
6060 is enrolled:
6161 [(1) a campus designated as a P-TECH school under
6262 Section 29.556; or
6363 [(2) a campus that is a member of the New Tech Network
6464 and that focuses on project-based learning and work-based
6565 education].
6666 SECTION 3. This Act applies beginning with the 2025-2026
6767 school year.
6868 SECTION 4. This Act takes effect immediately if it receives
6969 a vote of two-thirds of all the members elected to each house, as
7070 provided by Section 39, Article III, Texas Constitution. If this
7171 Act does not receive the vote necessary for immediate effect, this
7272 Act takes effect September 1, 2025.
