77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to Medicaid reimbursement for the costs of cognitive
1010 assessment and care planning services provided to certain patients.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter D, Chapter 532, Government Code, as
1313 effective April 1, 2025, is amended by adding Section 532.0158 to
1414 read as follows:
1515 Sec. 532.0158. REIMBURSEMENT SYSTEM FOR COGNITIVE CARE
1616 PLANNING. (a) The executive commissioner by rule shall develop and
1717 the commission shall implement a system to provide Medicaid
1818 reimbursement to a health care provider, including a physician, for
1919 the assessment of and care planning services provided to patients
2020 with a cognitive impairment, including dementia or Alzheimer's
2121 disease.
2222 (b) To be eligible for reimbursement under this section, the
2323 health care provider's care planning services must include:
2424 (1) assessment of the patient's cognition, function,
2525 and safety;
2626 (2) an evaluation of the patient's neuropsychiatric
2727 and behavioral symptoms;
2828 (3) a review of the patient's medications;
2929 (4) a needs assessment for the patient's caregiver;
3030 (5) a comprehensive clinical visit for the patient;
3131 and
3232 (6) a complete written care plan for the patient.
3333 (c) The executive commissioner shall prepare and seek a
3434 waiver to the state Medicaid plan under Section 1115 of the Social
3535 Security Act (42 U.S.C. Section 1315) or other applicable federal
3636 law to obtain any federal money available for implementing the
3737 system to assist eligible individuals in obtaining care planning
3838 services.
3939 SECTION 2. (a) As soon as practicable after the effective
4040 date of this Act, the executive commissioner of the Health and Human
4141 Services Commission shall adopt the rules necessary to implement
4242 Section 532.0158, Government Code, as added by this Act.
4343 (b) As soon as practicable after the effective date of this
4444 Act, the executive commissioner of the Health and Human Services
4545 Commission shall apply for and actively pursue from the federal
4646 Centers for Medicare and Medicaid Services or another appropriate
4747 federal agency the waiver required by Section 532.0158, Government
4848 Code, as added by this Act. The commission may delay implementing
4949 Section 532.0158, Government Code, until the waiver applied for
5050 under this section is granted.
5151 SECTION 3. This Act takes effect September 1, 2025.
