77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to conditions of community supervision for defendants
1010 convicted of certain criminal offenses involving animals.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Articles 42A.511(a) and (b), Code of Criminal
1313 Procedure, are amended to read as follows:
1414 (a) If a judge grants community supervision to a defendant
1515 convicted of an offense under Section 42.09, 42.091, 42.092, or
1616 42.10, Penal Code, the judge may require the defendant to:
1717 (1) complete an online responsible pet owner course
1818 that is at least two hours in duration [approved and certified by
1919 the Texas Department of Licensing and Regulation]; or
2020 (2) complete [attend] a responsible pet owner course
2121 sponsored by a municipal animal shelter, as defined by Section
2222 823.001, Health and Safety Code, that:
2323 (A) receives federal, state, county, or
2424 municipal funds; and
2525 (B) serves the county in which the court is
2626 located.
2727 (b) An [For purposes of the] online responsible pet owner
2828 course described by Subsection (a)(1) must include information
2929 regarding [, the Texas Department of Licensing and Regulation or
3030 the Texas Commission of Licensing and Regulation, as appropriate]:
3131 (1) federal and state laws that protect livestock
3232 animals, nonlivestock animals, and wildlife, including:
3333 (A) animal cruelty laws;
3434 (B) dogfighting laws; and
3535 (C) laws prohibiting attacks on assistance
3636 animals;
3737 (2) responsible care for animals, including spaying,
3838 neutering, and tethering animals, and generally providing for the
3939 health, safety, and welfare of livestock animals, nonlivestock
4040 animals, and wildlife;
4141 (3) animal bite prevention; and
4242 (4) laws governing dog and cat breeders under Chapter
4343 802, Occupations Code [is responsible for the approval,
4444 certification, and administration of the course and course
4545 providers;
4646 [(2) may charge fees for:
4747 [(A) initial and renewal course certifications;
4848 [(B) initial and renewal course provider
4949 certifications;
5050 [(C) course participant completion certificates;
5151 and
5252 [(D) other fees necessary for the administration
5353 of the course and course providers;
5454 [(3) shall adopt rules regarding the administration of
5555 the course and course providers, including rules regarding:
5656 [(A) the criteria for course approval and
5757 certification;
5858 [(B) the criteria for course provider approval
5959 and certification;
6060 [(C) curriculum development;
6161 [(D) course length and content;
6262 [(E) criteria for a participant to complete the
6363 course; and
6464 [(F) a course completion certificate that is
6565 acceptable to a court;
6666 [(4) is authorized to monitor and audit the provision
6767 of the course by the course providers; and
6868 [(5) may take enforcement actions as appropriate to
6969 enforce this subsection].
7070 SECTION 2. The change in law made by this Act applies to a
7171 defendant placed on community supervision on or after the effective
7272 date of this Act, regardless of whether the offense for which the
7373 defendant was placed on community supervision was committed before,
7474 on, or after the effective date of this Act.
7575 SECTION 3. This Act takes effect September 1, 2025.
