77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to electronic delivery of documents sent or received by
1010 the Texas Department of Licensing and Regulation.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 51.207, Occupations Code, is amended by
1313 amending Subsection (c) and adding Subsection (d) to read as
1414 follows:
1515 (c) The commission by rule may require an applicant or [,]
1616 license holder[, or other person who regularly receives
1717 correspondence from the department] to provide an e-mail address to
1818 the department [for purposes of receiving correspondence]. An
1919 e-mail address used under this subsection is confidential and is
2020 not subject to disclosure under Chapter 552, Government Code.
2121 (d) Notwithstanding any other law, the commission by rule
2222 may provide that any correspondence sent or received by the
2323 department be delivered electronically, including any notice,
2424 order, or pleading required under Chapter 2001, Government Code,
2525 this chapter, or a law establishing a regulatory program
2626 administered by the department.
2727 SECTION 2. Sections 51.310(c) and 51.354(c), Occupations
2828 Code, are repealed.
2929 SECTION 3. This Act takes effect September 1, 2025.
