77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the transfer of certain malt beverages between two or
1010 more licensed premises operating under the same general ownership
1111 or management.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Chapter 62, Alcoholic Beverage Code, is amended
1414 by adding Section 62.085 to read as follows:
1515 Sec. 62.085. TRANSFER OF MALT BEVERAGES. (a) The holder of
1616 a brewer's license may transfer malt beverages produced under the
1717 license between any of the license holder's licensed brewery
1818 premises, including a facility operating under an alternating
1919 brewery proprietorship or contract brewing arrangement as provided
2020 by Section 62.14, during the hours provided by Section 105.051,
2121 subject to rules prescribed by the commission.
2222 (b) The holder of a brewer's license may not transport malt
2323 beverages under Subsection (a) unless:
2424 (1) the license holder provides the commission with a
2525 description, as required by the commission, of each motor vehicle
2626 used by the license holder to transport malt beverages; and
2727 (2) each motor vehicle is plainly marked or lettered
2828 to indicate that it is being used by the license holder to transport
2929 malt beverages.
3030 (c) When transporting malt beverages under this section,
3131 the holder of a brewer's license may not violate the motor carrier
3232 laws of this state.
3333 (d) For purposes of Section 62.122, a malt beverage
3434 transported under this section is considered to be produced on the
3535 premises where the malt beverage is produced and may not be
3636 considered to be produced on the premises to which the malt beverage
3737 is transported.
3838 SECTION 2. Section 69.11, Alcoholic Beverage Code, is
3939 amended to read as follows:
4040 Sec. 69.11. EXCHANGE OR TRANSPORTATION OF MALT BEVERAGES
4141 BETWEEN LICENSED PREMISES UNDER SAME OWNERSHIP. (a) Except as
4242 provided by Subsection (b), the [The] owner of two or more licensed
4343 retail premises may not exchange or transport malt beverages
4444 between them.
4545 (b) Malt [unless all of the conditions set out in Section
4646 24.04 are met, except that malt] beverages may be transferred
4747 between:
4848 (1) two licensed retail premises that are both covered
4949 by package store permits as provided in Section 22.08; or
5050 (2) two licensed brewpubs operating under the same
5151 general management or ownership as provided in Section 74.12.
5252 SECTION 3. Chapter 74, Alcoholic Beverage Code, is amended
5353 by adding Section 74.12 to read as follows:
5454 Sec. 74.12. TRANSFER OF BEVERAGES. (a) The holder of a
5555 brewpub license operating more than one brewpub as authorized by
5656 Section 74.01(b) may transfer malt beverages brewed under the
5757 license between any of the license holder's brewpubs during the
5858 hours provided by Section 105.051, subject to rules prescribed by
5959 the commission.
6060 (b) The holder of a brewpub license may not transport malt
6161 beverages under Subsection (a) unless:
6262 (1) the license holder provides the commission with a
6363 description, as required by the commission, of each motor vehicle
6464 used by the license holder to transport malt beverages; and
6565 (2) each motor vehicle is plainly marked or lettered
6666 to indicate that it is being used by the license holder to transport
6767 malt beverages.
6868 (c) When transporting malt beverages under this section,
6969 the holder of a brewpub license may not violate the motor carrier
7070 laws of this state.
7171 (d) For purposes of Sections 74.03 and 74.08, a malt
7272 beverage transported under this section is considered to be brewed
7373 by the brewpub where the malt beverage is brewed and may not be
7474 considered to be brewed by the brewpub to which the malt beverage is
7575 transported.
7676 SECTION 4. This Act takes effect September 1, 2025.
