11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Section 821.022(a), Health and Safety Code, is | |
13 | 13 | amended to read as follows: | |
14 | 14 | (a) If a peace officer or an officer who has responsibility | |
15 | 15 | for animal control in a county or municipality has reason to believe | |
16 | 16 | that an animal has been or is being cruelly treated, the officer may | |
17 | 17 | apply to the following for a warrant to seize the animal: | |
18 | 18 | (1) a justice court or magistrate in: | |
19 | 19 | (A) the county in which the animal is located; or | |
20 | 20 | (B) a county adjacent to the county in which the | |
21 | 21 | animal is located; or | |
22 | 22 | (2) [to] a municipal court in: | |
23 | 23 | (A) the municipality in which the animal is | |
24 | 24 | located; or | |
25 | 25 | (B) a municipality adjacent to the municipality | |
26 | 26 | in which the animal is located [for a warrant to seize the animal]. | |
27 | 27 | SECTION 2. This Act takes effect September 1, 2025. |
