88 AN ACT
99 relating to factors the Department of Family and Protective
1010 Services must consider when selecting a foster care placement for a
1111 child.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 264.107(c), Family Code, is amended to
1414 read as follows:
1515 (c) In selecting a placement for a child, the department
1616 shall consider whether the placement is in the child's best
1717 interest. In determining whether a placement is in a child's best
1818 interest, the department shall consider whether the placement:
1919 (1) is the least restrictive setting for the child;
2020 (2) is the closest in geographic proximity to the
2121 child's home;
2222 (3) is the most able to meet the identified needs of
2323 the child; [and]
2424 (4) satisfies any expressed interests of the child
2525 relating to placement, when developmentally appropriate; and
2626 (5) is able to meet the long-term needs of the child,
2727 including placement stability.
2828 SECTION 2. This Act takes effect September 1, 2025.
