12 | 12 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
13 | 13 | SECTION 1. Section 264.107(c), Family Code, is amended to | |
14 | 14 | read as follows: | |
15 | 15 | (c) In selecting a placement for a child, the department | |
16 | 16 | shall consider whether the placement is in the child's best | |
17 | 17 | interest. In determining whether a placement is in a child's best | |
18 | 18 | interest, the department shall consider whether the placement: | |
19 | 19 | (1) is the least restrictive setting for the child; | |
20 | 20 | (2) is the closest in geographic proximity to the | |
21 | 21 | child's home; | |
22 | 22 | (3) is the most able to meet the identified needs of | |
23 | 23 | the child; [and] | |
24 | 24 | (4) satisfies any expressed interests of the child | |
25 | 25 | relating to placement, when developmentally appropriate; and | |
26 | 26 | (5) is able to meet the long-term needs of the child, | |
27 | 27 | including placement stability. | |
28 | 28 | SECTION 2. This Act takes effect September 1, 2025. |
