77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to prohibiting certain additives from being included in
1010 food and drinks provided by school districts or purchased under the
1111 supplemental nutrition assistance program.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter Z, Chapter 33, Education Code, is
1414 amended by adding Section 33.9011 to read as follows:
1515 Sec. 33.9011. PROHIBITION ON CERTAIN ADDITIVES IN FOOD AND
1616 DRINKS PROVIDED BY SCHOOLS. A school district or open-enrollment
1717 charter school that provides meals to students may not provide any
1818 food or drink that contains the following substances:
1919 (1) red 3 (CAS 16423-68-0);
2020 (2) red 40 (CAS 25956-17-6);
2121 (3) yellow 5 (CAS 1934-21-0);
2222 (4) yellow 6 (CAS 2783-94-0);
2323 (5) blue 1 (CAS 3844-45-9);
2424 (6) blue 2 (CAS 860-22-0);
2525 (7) green 3 (CAS 2353-45-9);
2626 (8) citrus red dye 2 (CAS 6358-53-8); or
2727 (9) orange B dye (CAS 15139-76-1).
2828 SECTION 2. Subchapter A, Chapter 33, Human Resources Code,
2929 is amended by adding Section 33.031 to read as follows:
3030 Sec. 33.031. PURCHASE OF FOOD AND DRINK ITEMS CONTAINING
3131 CERTAIN FOOD ADDITIVES PROHIBITED UNDER SUPPLEMENTAL NUTRITION
3232 ASSISTANCE PROGRAM. Except as expressly required by federal law, a
3333 recipient of supplemental nutrition assistance program benefits
3434 may not use those benefits to purchase any food or drink item that
3535 contains the following substances:
3636 (1) red 3 (CAS 16423-68-0);
3737 (2) red 40 (CAS 25956-17-6);
3838 (3) yellow 5 (CAS 1934-21-0);
3939 (4) yellow 6 (CAS 2783-94-0);
4040 (5) blue 1 (CAS 3844-45-9);
4141 (6) blue 2 (CAS 860-22-0);
4242 (7) green 3 (CAS 2353-45-9);
4343 (8) citrus red dye 2 (CAS 6358-53-8); or
4444 (9) orange B dye (CAS 15139-76-1).
4545 SECTION 3. This Act applies beginning with the 2027-2028
4646 school year.
4747 SECTION 4. If before implementing any provision of this Act
4848 a state agency determines that a waiver or authorization from a
4949 federal agency is necessary for implementation of that provision,
5050 the agency affected by the provision shall request the waiver or
5151 authorization and may delay implementing that provision until the
5252 waiver or authorization is granted.
5353 SECTION 5. This Act takes effect September 1, 2027.
