9 | 9 | | relating to prohibiting certain additives from being included in |

10 | 10 | | food and drinks provided by school districts or purchased under the |
---|
11 | 11 | | supplemental nutrition assistance program. |

12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

13 | 13 | | SECTION 1. Subchapter Z, Chapter 33, Education Code, is |
---|
14 | 14 | | amended by adding Section 33.9011 to read as follows: |
---|
15 | 15 | | Sec. 33.9011. PROHIBITION ON CERTAIN ADDITIVES IN FOOD AND |
---|
16 | 16 | | DRINKS PROVIDED BY SCHOOLS. A school district or open-enrollment |
---|
17 | 17 | | charter school that provides meals to students may not provide any |
---|
18 | 18 | | food or drink that contains the following substances: |
---|
19 | 19 | | (1) red 3 (CAS 16423-68-0); |
---|
20 | 20 | | (2) red 40 (CAS 25956-17-6); |
---|
21 | 21 | | (3) yellow 5 (CAS 1934-21-0); |
---|
22 | 22 | | (4) yellow 6 (CAS 2783-94-0); |
---|
23 | 23 | | (5) blue 1 (CAS 3844-45-9); |
---|
24 | 24 | | (6) blue 2 (CAS 860-22-0); |
---|
25 | 25 | | (7) green 3 (CAS 2353-45-9); |
---|
26 | 26 | | (8) citrus red dye 2 (CAS 6358-53-8); or |
---|
27 | 27 | | (9) orange B dye (CAS 15139-76-1). |

28 | 28 | | SECTION 2. Subchapter A, Chapter 33, Human Resources Code, |
---|
29 | 29 | | is amended by adding Section 33.031 to read as follows: |
---|
30 | 30 | | Sec. 33.031. PURCHASE OF FOOD AND DRINK ITEMS CONTAINING |
---|
31 | 31 | | CERTAIN FOOD ADDITIVES PROHIBITED UNDER SUPPLEMENTAL NUTRITION |
---|
32 | 32 | | ASSISTANCE PROGRAM. Except as expressly required by federal law, a |
---|
33 | 33 | | recipient of supplemental nutrition assistance program benefits |
---|
34 | 34 | | may not use those benefits to purchase any food or drink item that |
---|
35 | 35 | | contains the following substances: |
---|
36 | 36 | | (1) red 3 (CAS 16423-68-0); |
---|
37 | 37 | | (2) red 40 (CAS 25956-17-6); |
---|
38 | 38 | | (3) yellow 5 (CAS 1934-21-0); |
---|
39 | 39 | | (4) yellow 6 (CAS 2783-94-0); |

45 | 45 | | SECTION 3. This Act applies beginning with the 2027-2028 |
---|
46 | 46 | | school year. |
---|
47 | 47 | | SECTION 4. If before implementing any provision of this Act |
---|
48 | 48 | | a state agency determines that a waiver or authorization from a |
---|
49 | 49 | | federal agency is necessary for implementation of that provision, |
---|
50 | 50 | | the agency affected by the provision shall request the waiver or |
---|
51 | 51 | | authorization and may delay implementing that provision until the |
---|
52 | 52 | | waiver or authorization is granted. |
---|
53 | 53 | | SECTION 5. This Act takes effect September 1, 2027. |
---|
