77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the waiver of certain minimum standards for law
1010 enforcement agencies based on financial hardship.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 1701.163, Occupations Code, is amended
1313 to read as follows:
1414 Sec. 1701.163. MINIMUM STANDARDS FOR LAW ENFORCEMENT
1515 AGENCIES; WAIVER BASED ON FINANCIAL HARDSHIP. (a) The commission,
1616 with input from an advisory committee, shall by rule establish
1717 minimum standards with respect to the creation or continued
1818 operation of a law enforcement agency based on the function, size,
1919 and jurisdiction of the agency, including:
2020 (1) a determination regarding the public benefit of
2121 creating the agency in the community;
2222 (2) the sustainable funding sources for the agency;
2323 (3) the physical resources available to officers,
2424 including:
2525 (A) all standard duty firearms;
2626 (B) less lethal force weapons, including a
2727 requirement of at least one per officer on duty;
2828 (C) effective communications equipment;
2929 (D) protective equipment, including a
3030 requirement of at least one bullet-resistant vest per officer on
3131 duty;
3232 (E) officer uniforms; and
3333 (F) patrol vehicles and associated equipment;
3434 (4) the physical facilities of the agency, including
3535 any evidence room, dispatch area, or public area;
3636 (5) the policies of the agency, including policies on:
3737 (A) use of force;
3838 (B) vehicle pursuit;
3939 (C) professional conduct of officers;
4040 (D) domestic abuse protocols;
4141 (E) response to missing persons;
4242 (F) supervision of part-time officers;
4343 (G) impartial policing;
4444 (H) active shooters; and
4545 (I) barricaded subjects;
4646 (6) the administrative structure of the agency;
4747 (7) liability insurance; and
4848 (8) any other standard the commission considers
4949 necessary.
5050 (b) On written request by a law enforcement agency, the
5151 commission shall grant the agency a waiver from complying with a
5252 minimum standard established under Subsection (a) if the commission
5353 determines the agency is unable to comply with the minimum standard
5454 primarily based on a financial hardship experienced by the agency.
5555 A request for a waiver under this subsection must include evidence
5656 of the agency's financial hardship.
5757 SECTION 2. This Act takes effect immediately if it receives
5858 a vote of two-thirds of all the members elected to each house, as
5959 provided by Section 39, Article III, Texas Constitution. If this
6060 Act does not receive the vote necessary for immediate effect, this
6161 Act takes effect September 1, 2025.
