57 AN ACT
68 relating to the evaluation of the physical fitness of certain peace
79 officers.
810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. Chapter 370, Local Government Code, is amended
1012 by adding Section 370.010 to read as follows:
1113 Sec. 370.010. PEACE OFFICER PHYSICAL FITNESS STANDARDS AND
1214 EVALUATION. (a) Each law enforcement agency of a political
1315 subdivision shall:
1416 (1) adopt physical fitness standards for peace
1517 officers that are at least as stringent as the physical fitness
1618 standards adopted by the Department of Public Safety under Section
1719 614.172, Government Code; and
1820 (2) annually evaluate the physical fitness of each
1921 peace officer employed by the agency based on the standards adopted
2022 under Subdivision (1).
2123 (b) Each law enforcement agency shall require a peace
2224 officer employed by the agency who fails to meet a standard adopted
2325 under Subsection (a)(1) to participate in a physical fitness
2426 program described by Section 1701.171, Occupations Code, provided
2527 by the agency until the officer meets the standard.
2628 SECTION 2. Subchapter D, Chapter 1701, Occupations Code, is
2729 amended by adding Section 1701.171 to read as follows:
2830 Sec. 1701.171. PHYSICAL FITNESS PROGRAM FOR OFFICERS. The
2931 commission shall develop and make available to law enforcement
3032 agencies a physical fitness program providing diet and exercise
3133 recommendations for officers.
3234 SECTION 3. As soon as practicable after the effective date
3335 of this Act:
3436 (1) each law enforcement agency of a political
3537 subdivision shall adopt the physical fitness standards required by
3638 Section 370.010, Local Government Code, as added by this Act; and
3739 (2) the Texas Commission on Law Enforcement shall
3840 develop and make available the physical fitness program required by
3941 Section 1701.171, Occupations Code, as added by this Act.
4042 SECTION 4. This Act takes effect September 1, 2026.
