| 8 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 11 | | SECTION 1. Chapter 370, Local Government Code, is amended |
|---|
| 10 | 12 | | by adding Section 370.010 to read as follows: |
|---|
| 11 | 13 | | Sec. 370.010. PEACE OFFICER PHYSICAL FITNESS STANDARDS AND |
|---|
| 12 | 14 | | EVALUATION. (a) Each law enforcement agency of a political |
|---|
| 13 | 15 | | subdivision shall: |
|---|
| 14 | 16 | | (1) adopt physical fitness standards for peace |
|---|
| 15 | 17 | | officers that are at least as stringent as the physical fitness |
|---|
| 16 | 18 | | standards adopted by the Department of Public Safety under Section |
|---|
| 17 | 19 | | 614.172, Government Code; and |
|---|
| 18 | 20 | | (2) annually evaluate the physical fitness of each |
|---|
| 19 | 21 | | peace officer employed by the agency based on the standards adopted |
|---|
| 20 | 22 | | under Subdivision (1). |
|---|
| 21 | 23 | | (b) Each law enforcement agency shall require a peace |
|---|
| 22 | 24 | | officer employed by the agency who fails to meet a standard adopted |
|---|
| 23 | 25 | | under Subsection (a)(1) to participate in a physical fitness |
|---|
| 24 | 26 | | program described by Section 1701.171, Occupations Code, provided |
|---|
| 25 | 27 | | by the agency until the officer meets the standard. |
|---|
| 26 | 28 | | SECTION 2. Subchapter D, Chapter 1701, Occupations Code, is |
|---|
| 27 | 29 | | amended by adding Section 1701.171 to read as follows: |
|---|
| 28 | 30 | | Sec. 1701.171. PHYSICAL FITNESS PROGRAM FOR OFFICERS. The |
|---|
| 29 | 31 | | commission shall develop and make available to law enforcement |
|---|
| 30 | 32 | | agencies a physical fitness program providing diet and exercise |
|---|
| 31 | 33 | | recommendations for officers. |
|---|
| 32 | 34 | | SECTION 3. As soon as practicable after the effective date |
|---|
| 33 | 35 | | of this Act: |
|---|
| 34 | 36 | | (1) each law enforcement agency of a political |
|---|
| 35 | 37 | | subdivision shall adopt the physical fitness standards required by |
|---|
| 36 | 38 | | Section 370.010, Local Government Code, as added by this Act; and |
|---|
| 37 | 39 | | (2) the Texas Commission on Law Enforcement shall |
|---|
| 38 | 40 | | develop and make available the physical fitness program required by |
|---|
| 39 | 41 | | Section 1701.171, Occupations Code, as added by this Act. |
|---|
| 40 | 42 | | SECTION 4. This Act takes effect September 1, 2026. |
