| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. The heading to Section 247.0261, Health and |
|---|
| 13 | 13 | | Safety Code, is amended to read as follows: |
|---|
| 14 | 14 | | Sec. 247.0261. [EARLY] COMPLIANCE REVIEW REQUIRED BEFORE |
|---|
| 15 | 15 | | COMPLETION. |
|---|
| 16 | 16 | | SECTION 2. Section 247.0261(a), Health and Safety Code, is |
|---|
| 17 | 17 | | amended to read as follows: |
|---|
| 18 | 18 | | (a) The executive commissioner by rule shall adopt a |
|---|
| 19 | 19 | | procedure under which a person who constructs or modifies an |
|---|
| 20 | 20 | | assisted living facility or proposes [proposing] to construct or |
|---|
| 21 | 21 | | modify an assisted living facility may submit building plans to the |
|---|
| 22 | 22 | | department for review for compliance with the department's |
|---|
| 23 | 23 | | architectural requirements before completing [beginning] |
|---|
| 24 | 24 | | construction or modification. In adopting the procedure, the |
|---|
| 25 | 25 | | executive commissioner shall set reasonable deadlines by which the |
|---|
| 26 | 26 | | department must complete review of submitted plans. |
|---|
| 27 | 27 | | SECTION 3. Subchapter B, Chapter 247, Health and Safety |
|---|
| 28 | 28 | | Code, is amended by adding Section 247.02615 to read as follows: |
|---|
| 29 | 29 | | Sec. 247.02615. LIFE SAFETY CODE SURVEYS AUTHORIZED BEFORE |
|---|
| 30 | 30 | | COMPLETION. A person who constructs or modifies an assisted living |
|---|
| 31 | 31 | | facility may request a life safety code survey for the facility |
|---|
| 32 | 32 | | before the construction or modification is completed. |
|---|
| 33 | 33 | | SECTION 4. As soon as practicable after the effective date |
|---|
| 34 | 34 | | of this Act, the executive commissioner of the Health and Human |
|---|
| 35 | 35 | | Services Commission shall adopt rules necessary to implement the |
|---|
| 36 | 36 | | changes in law made by this Act. |
|---|
| 37 | 37 | | SECTION 5. This Act takes effect September 1, 2025. |
