57 AN ACT
68 Relating to the deposit of federal reimbursements for border
79 security operations into the general revenue fund and the funding
810 of services and programs in the border region.
911 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1012 ARTICLE 1. USE OF FEDERAL REIMBURSEMENT FOR BORDER SECURITY
1113 OPERATIONS
1214 SECTION 1.01. Section 403.093, Government Code, is amended
1315 to read as follows:
1416 (f) Notwithstanding any other provision of law, any funds
1517 received by the state as reimbursement from the federal government
1618 for costs associated with any border security operations or
1719 expenditures since fiscal year 2008, shall be deposited into the
1820 general revenue fund.
1921 (g) Funds deposited under subsection (f) shall be used
2022 solely for the purpose of projects qualified under Sec. 421.112,
2123 Government Code in counties located within 45 miles from the
2224 Texas-Mexico border.
2325 ARTICLE 2. GRANT PROGRAM FOR THE BORDER REGION
2426 SECTION 2.01. Chapter 421, Government Code, is amended by
2527 adding Subchapter G to read as follows:
2628 SUBCHAPTER G. GRANT PROGRAMS FOR INFRASTRUCTURE, FACILITIES,
2729 EQUIPMENT, AND SERVICES IN THE BORDER REGION
2830 Sec. 421.111. DEFINITIONS. In this subchapter:
2931 (1) "Border region" means a county located within 45
3032 miles from the Texas-Mexico border.
3133 (3) "Local government" means a municipality, county,
3234 special purpose district, or other political subdivision of this
3335 state.
3436 Sec. 421.112. GRANTS PROGRAMS. The comptroller shall
3537 administer grant programs to award funds to local governments or
3638 entities in the border region for:
3739 (1) infrastructure, technology, and equipment to
3840 enhance security and public safety;
3941 (2) facilities related to law enforcement,
4042 prosecution, and adjudication; and
4143 (3) other projects or initiatives necessary for the
4244 region's security and economic development.
4345 Sec. 421.113. FEDERAL FUNDS; GIFTS, GRANTS, AND DONATIONS.
4446 In addition to other funds appropriated by this act and for purposes
4547 of administering and funding the grant programs established under
4648 Section 421.112, the comptroller may:
4749 (1) seek and apply for any available federal funds;
4850 and
4951 (2) solicit and accept gifts, grants, and donations
5052 from any other source, public or private, as necessary to ensure
5153 effective implementation of the programs.
5254 Sec. 421.114. RULES. (a) The comptroller shall adopt rules
5355 for the administration of this subchapter.
5456 (b) In adopting the rules, the comptroller shall solicit
5557 from public officials and community leaders in the border region
5658 and any other interested stakeholders information necessary to
5759 identify the greatest needs for financial assistance in that
5860 region.
5961 (c) In adopting rules that relate to the grant programs
6062 established under Section 421.112, the comptroller shall consult
6163 federal agencies, state agencies, local governments, and private
6264 entities with the relevant knowledge and expertise.
6365 (d) The rules must include:
6466 (1) administrative provisions for grants awarded
6567 under this subchapter, including:
6668 (A) eligibility criteria for grant applicants;
6769 (B) grant application procedures;
6870 (C) guidelines relating to grant amounts;
6971 (D) procedures for evaluating grant
7072 applications;
7173 (E) procedures for monitoring the use of grants;
7274 and
7375 (F) procedures for re-awarding of a grant due to
7476 technical error.
7577 (2) methods for tracking the effectiveness of grants;
7678 and
7779 (3) provisions for donations to the grant program
7880 established under Section 421.112.
7981 Sec. 421.115. GRANT AMOUNTS. The amount of a grant awarded
8082 under this subchapter may not exceed the amount set by the General
8183 Appropriations Act.
8284 Sec. 421.116. REPORTING REQUIREMENTS. The recipient of a
8385 grant awarded under this subchapter shall submit to the comptroller
8486 an annual report on the grant money spent during the year covered by
8587 the report and the purposes for which that money was spent.
8688 Sec. 421.117. ADMINISTRATIVE COSTS. Unless otherwise
8789 provided by the appropriation, the comptroller may use a reasonable
8890 amount, not to exceed five percent, of any general revenue
8991 appropriated for purposes of this subchapter to pay the costs of
9092 administering this subchapter.
9193 ARTICLE 3. EFFECTIVE DATE
9294 SECTION 3.01. This Act takes effect September 1, 2025.
