46 A BILL TO BE ENTITLED
57 AN ACT
68 relating to the applicability of certain laws pertaining to energy
79 aggregation by political subdivisions.
810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. Section 12.1058(a), Education Code, is amended
1012 to read as follows:
1113 (a) An open-enrollment charter school is considered to be:
1214 (1) a local government for purposes of Chapter 791,
1315 Government Code;
1416 (2) a local government for purposes of Chapter 2259,
1517 Government Code, except that an open-enrollment charter school may
1618 not issue public securities as provided by Section 2259.031(b),
1719 Government Code;
1820 (3) a political subdivision for purposes of Chapter
1921 172, Local Government Code;
2022 (4) a local governmental entity for purposes of
2123 Subchapter I, Chapter 271, Local Government Code;
2224 (5) a political subdivision for purposes of Section
2325 180.008, Local Government Code;
2426 (6) a political subdivision for purposes of Section
2527 16.061, Civil Practice and Remedies Code, with respect to any
2628 property purchased, leased, constructed, renovated, or improved
2729 with state funds under Section 12.128 of this code; [and]
2830 (7) a political subdivision for purposes of Section
2931 11.11, Tax Code; and
3032 (8) a political subdivision for purposes of Section
3133 304.001, Local Government Code.
3234 SECTION 2. This Act takes effect September 1, 2025.
