77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the governance of public housing authorities
1010 established by municipalities.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 392.031(a), Local Government Code, is
1313 amended to read as follows:
1414 (a) Each municipal housing authority shall be governed by
1515 five, seven, nine, or 11 commissioners. The [presiding officer of
1616 the] governing body of a municipality by majority vote shall
1717 appoint five, seven, nine, or 11 persons to serve as commissioners
1818 of the authority. An appointed commissioner of the authority may
1919 not be an officer or employee of the municipality. Appointments
2020 made under this section must comply with the requirements of
2121 Section 392.0331, if applicable.
2222 SECTION 2. Section 392.0331(b-1), Local Government Code, is
2323 amended to read as follows:
2424 (b-1) The [presiding officer of the] governing body of a
2525 municipality that has a municipal housing authority in which the
2626 total number of units is 150 or fewer is not required to appoint a
2727 tenant or a recipient of housing assistance to the position of
2828 commissioner as otherwise required by Subsection (b) if the
2929 governing body [presiding officer] has provided timely notice of a
3030 vacancy in the position to all eligible tenants or recipients of
3131 housing assistance and is unable to fill the position with an
3232 eligible tenant or recipient of housing assistance before the 60th
3333 day after the date the position becomes vacant.
3434 SECTION 3. The change in law made by this Act in amending
3535 Section 392.031, Local Government Code, does not affect the ability
3636 of a commissioner of a housing authority who was appointed by the
3737 presiding officer of the governing body of a municipality under
3838 that section and who is serving on the effective date of this Act to
3939 continue to serve the remainder of the term to which the member is
4040 appointed. As the terms of commissioners of the housing authority
4141 expire or as a vacancy is created in a commissioner's position, the
4242 governing body of the municipality shall appoint the members as
4343 required by Section 392.031, Local Government Code, as amended by
4444 this Act.
4545 SECTION 4. This Act takes effect September 1, 2025.
