| 9 | 9 | | relating to the governance of public housing authorities |

| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 392.031(a), Local Government Code, is |
|---|
| 13 | 13 | | amended to read as follows: |
|---|
| 14 | 14 | | (a) Each municipal housing authority shall be governed by |
|---|
| 15 | 15 | | five, seven, nine, or 11 commissioners. The [presiding officer of |
|---|
| 16 | 16 | | the] governing body of a municipality by majority vote shall |
|---|
| 17 | 17 | | appoint five, seven, nine, or 11 persons to serve as commissioners |
|---|
| 18 | 18 | | of the authority. An appointed commissioner of the authority may |
|---|
| 19 | 19 | | not be an officer or employee of the municipality. Appointments |
|---|
| 20 | 20 | | made under this section must comply with the requirements of |
|---|
| 21 | 21 | | Section 392.0331, if applicable. |
|---|
| 22 | 22 | | SECTION 2. Section 392.0331(b-1), Local Government Code, is |
|---|
| 23 | 23 | | amended to read as follows: |
|---|
| 24 | 24 | | (b-1) The [presiding officer of the] governing body of a |
|---|
| 25 | 25 | | municipality that has a municipal housing authority in which the |
|---|
| 26 | 26 | | total number of units is 150 or fewer is not required to appoint a |
|---|
| 27 | 27 | | tenant or a recipient of housing assistance to the position of |
|---|
| 28 | 28 | | commissioner as otherwise required by Subsection (b) if the |
|---|
| 29 | 29 | | governing body [presiding officer] has provided timely notice of a |
|---|
| 30 | 30 | | vacancy in the position to all eligible tenants or recipients of |
|---|
| 31 | 31 | | housing assistance and is unable to fill the position with an |
|---|
| 32 | 32 | | eligible tenant or recipient of housing assistance before the 60th |
|---|
| 33 | 33 | | day after the date the position becomes vacant. |
|---|
| 34 | 34 | | SECTION 3. The change in law made by this Act in amending |
|---|
| 35 | 35 | | Section 392.031, Local Government Code, does not affect the ability |
|---|
| 36 | 36 | | of a commissioner of a housing authority who was appointed by the |
|---|
| 37 | 37 | | presiding officer of the governing body of a municipality under |
|---|
| 38 | 38 | | that section and who is serving on the effective date of this Act to |
|---|
| 39 | 39 | | continue to serve the remainder of the term to which the member is |
|---|
| 40 | 40 | | appointed. As the terms of commissioners of the housing authority |
|---|
| 41 | 41 | | expire or as a vacancy is created in a commissioner's position, the |
|---|
| 42 | 42 | | governing body of the municipality shall appoint the members as |
|---|
| 43 | 43 | | required by Section 392.031, Local Government Code, as amended by |
|---|
| 44 | 44 | | this Act. |
|---|
| 45 | 45 | | SECTION 4. This Act takes effect September 1, 2025. |
