| 10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 11 | 11 | SECTION 1. Section 34.0106, Utilities Code, is amended by | |
| 12 | 12 | adding Subsection (f) to read as follows: | |
| 13 | 13 | (f) Notwithstanding any other law, the commission may not | |
| 14 | 14 | allocate more than $5 billion from the fund to provide loans or | |
| 15 | 15 | grants under Section 34.0104 or 34.0105 until the maximum amount of | |
| 16 | 16 | money from the fund allowed under Subsections (e)(1) and (3) has | |
| 17 | 17 | been allocated to provide: | |
| 18 | 18 | (1) grants under Section 34.0103; and | |
| 19 | 19 | (2) grants or loans under Subchapter B. | |
| 20 | 20 | SECTION 2. This Act takes effect immediately if it receives | |
| 21 | 21 | a vote of two-thirds of all the members elected to each house, as | |
| 22 | 22 | provided by Section 39, Article III, Texas Constitution. If this | |
| 23 | 23 | Act does not receive the vote necessary for immediate effect, this | |
| 24 | 24 | Act takes effect September 1, 2025. |
