77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the use by a political subdivision of public funds for
1010 lobbying and certain other activities.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 556, Government Code, is amended by
1313 adding Section 556.0056 to read as follows:
1414 Sec. 556.0056. RESTRICTION ON USE OF PUBLIC FUNDS BY
1515 POLITICAL SUBDIVISIONS FOR LOBBYING ACTIVITIES. (a) A political
1616 subdivision may not spend public funds:
1717 (1) to hire an individual required to register as a
1818 lobbyist under Chapter 305 for the purpose of lobbying a member of
1919 the legislature; or
2020 (2) to pay a nonprofit state association or
2121 organization that:
2222 (A) primarily represents political subdivisions;
2323 and
2424 (B) hires or contracts with an individual
2525 required to register as a lobbyist under Chapter 305.
2626 (b) Subsection (a) does not prohibit:
2727 (1) an officer or employee of a political subdivision
2828 from providing information for a member of the legislature or
2929 appearing before a legislative committee;
3030 (2) an elected officer of a political subdivision from
3131 advocating for or against or otherwise influencing or attempting to
3232 influence the outcome of legislation pending before the legislature
3333 while acting as an officer of the political subdivision;
3434 (3) an employee of a political subdivision from
3535 advocating for or against or otherwise influencing or attempting to
3636 influence the outcome of legislation pending before the legislature
3737 if those actions would not require a person to register as a
3838 lobbyist under Chapter 305;
3939 (4) a political subdivision from reimbursing an
4040 officer or full-time employee of the political subdivision for
4141 direct travel expenses incurred by the officer or employee for
4242 engaging in an activity described by Subdivision (1), (2), or (3);
4343 or
4444 (5) a full-time employee of a nonprofit state
4545 association or organization that primarily represents political
4646 subdivisions of this state from:
4747 (A) providing legislative services related to
4848 bill tracking, bill analysis, and legislative alerts;
4949 (B) communicating directly with a member of the
5050 legislature to provide information if the communication would not
5151 require a person to register as a lobbyist under Chapter 305; or
5252 (C) testifying for or against legislation before
5353 the legislature.
5454 (c) If a political subdivision engages in an activity
5555 prohibited by Subsection (a), a taxpayer or resident of the
5656 political subdivision is entitled to appropriate injunctive relief
5757 to prevent further activity prohibited by that subsection and
5858 further payment of public funds related to that activity.
5959 (d) A taxpayer or resident who prevails in an action under
6060 Subsection (c) is entitled to recover from the political
6161 subdivision the taxpayer's or resident's reasonable attorney's fees
6262 and costs incurred in bringing the action.
6363 SECTION 2. Section 89.002, Local Government Code, is
6464 amended to read as follows:
6565 Sec. 89.002. STATE ASSOCIATION OF COUNTIES. (a) Except as
6666 provided by Section 556.0056, Government Code, the [The]
6767 commissioners court may spend, in the name of the county, money from
6868 the county's general fund for membership fees and dues of a
6969 nonprofit state association of counties if:
7070 (1) a majority of the court votes to approve
7171 membership in the association;
7272 (2) the association exists for the betterment of
7373 county government and the benefit of all county officials;
7474 (3) the association is not affiliated with a labor
7575 organization; and
7676 (4) [neither the association nor an employee of the
7777 association directly or indirectly influences or attempts to
7878 influence the outcome of any legislation pending before the
7979 legislature, except that this subdivision does not prevent a person
8080 from providing information for a member of the legislature or
8181 appearing before a legislative committee at the request of the
8282 committee or the member of the legislature; and
8383 [(5)] neither the association nor an employee of the
8484 association directly or indirectly contributes any money,
8585 services, or other valuable thing to a political campaign or
8686 endorses a candidate or group of candidates for public office.
8787 (b) If any association or organization supported wholly or
8888 partly by payments of tax receipts from political subdivisions
8989 engages in an activity described by Subsection (a)(4) [or (5)], a
9090 taxpayer of a political subdivision that pays fees or dues to the
9191 association or organization is entitled to appropriate injunctive
9292 relief to prevent any further activity described by Subsection
9393 (a)(4) [or (5)] or any further payments of fees or dues.
9494 SECTION 3. Section 556.0056, Government Code, as added by
9595 this Act, applies only to an expenditure or payment of public funds
9696 by a political subdivision that is made on or after the effective
9797 date of this Act, including an expenditure or payment of public
9898 funds by a political subdivision that is made under a contract
9999 entered into before, on, or after the effective date of this Act. A
100100 contract term providing for an expenditure or payment prohibited by
101101 Section 556.0056, Government Code, as added by this Act, is void on
102102 the effective date of this Act.
103103 SECTION 4. Section 89.002, Local Government Code, as
104104 amended by this Act, applies only to the spending of money by a
105105 county from the county's general fund that occurs on or after the
106106 effective date of this Act. The spending of money by a county from
107107 the county's general fund that occurs before the effective date of
108108 this Act is governed by the law as it existed immediately before the
109109 effective date of this Act, and that law is continued in effect for
110110 that purpose.
111111 SECTION 5. This Act takes effect September 1, 2025.
